Texas Is The Only State With A Legal Right To Secede. What If We Did?

(Reference: the Texas-American Annexation Treaty of 1848)

The formal controversy about the legality of the annexation of Texas stems from the fact that Congress approved the annexation of Texas as a territory with a simple majority vote approval instead of annexing the land by Treaty, as was done with Native American lands )

We Texans love y’all, but we’ll probably have to take action if Barack Obama wins the election.  We’ll miss you too.

Here is what can happen:

1: Barack Hussein Obama is President of the United States, and Texas 
secedes from the Union in summer of 2013.

2: If we can find him, George W. Bush will become the President of the Republic of Texas. You might not think that he talks too pretty, but we haven’t had another terrorist attack, and the economy was fine until the effects of the Democrats lowering the qualifications for home loans came to roost.

So what does Texas have to do to survive as a Republic?

1. NASA is just south of Houston, Texas.  We will control the space industry.

2. We refine over 85% of the gasoline in the United States .

3. Defense Industry–we have over 65% of it.  The term “Don’t mess with Texas,” will take on a whole new meaning.

4. Oil – we can supply all the oil that the Republic of Texas will need for the next 300 years.  What will the other states do? Gee, we don’t know. Why not ask Obama?

5. Natural Gas – again we have all we need, and it’s too bad about those Northern States.  John Kerry and Al Gore will have to figure out a way to keep them warm….


6. Computer Industry – we lead the nation in producing computer chips and communications equipment – small companies like Texas Instruments, Dell 
Computer, EDS, Raytheon, National Semiconductor, Motorola, Intel, AMD, Atmel, Applied Materials, Ball Microconductor, Dallas Semiconductor, Nortel, Alcatel, etc., etc.  The list goes on and on.

7. Medical Care – We have the research centers for cancer research, the best burn centers and the top trauma units in the world, as well as other large health centers.  The Houston Medical Center alone employees over 65,000 people.

8. We have enough colleges to keep us getting smarter: University of Texas, Texas A&M, Texas Tech, Texas Christian, Rice, SMU, University of Dallas, University of Houston, Baylor, UNT (University of North Texas), Texas Women’s University, Texas State, etc.  Ivy grows better in the South anyway.

9. We have an intelligent and energetic work force, and it isn’t restricted by a bunch of unions.  Here in Texas, it’s a Right to Work State and, therefore, it’s every man and women for themselves.  We just go out and get the job done.  And if we don’t like the way one company operates, we get a job somewhere else.

10. We have essential control of the paper, plastics, and insurance industries, etc.

11. In case of a foreign invasion, we have the Texas National Guard, the Texas Air National Guard, and several military bases.  We don’t have an Army, but since everybody down here has at least six rifles and a pile of ammo, we can raise an Army in 24 hours if we need one.  If the situation really gets bad, we can always call the Department of Public Safety and ask them to send over the Texas Rangers.

12. We are totally self-sufficient in beef, poultry, hogs, and several types of grain, fruit and vegetables, and let’s not forget seafood from the Gulf.  Also, everybody down here knows how to cook them so that they taste good. Don’t need any food.

13. Three of the ten largest cities in the United States, and twenty-three of the 100 largest cities in the United States, are located in Texas.  And Texas also has more land than California, New York, New Jersey, Connecticut, Delaware, Hawaii, Massachusetts, Maryland, Rhode Island and Vermont combined.

14. Trade:  Three of the ten largest ports in the United States are located in Texas.

15. We also manufacture cars down here, but we don’t need to.  You see, nothing rusts in Texas, so our vehicles stay beautiful and run well for decades.

This just names a few of the items that will keep the Republic of Texas in good shape.  There isn’t a thing out there that we need and don’t have.

Now to the rest of the United States under President Obama:  Since you won’t have the refineries to get gas for your cars, only President Obama will be able to drive around in his big 5 mpg SUV.  The rest of the United States will have to walk or ride bikes.

You won’t have any TV as the Space Center in Houston will cut off satellite communications.  You won’t have any natural gas to heat your homes, but since Mr. Obama has predicted global warming, you will not need the gas as long as you survive the 2000 years it will take to get enough heat from Global Warming.

      Though I am completely sympathetic with what you say, I don’t think you have thought things through. First of all, the right to succeed didn’t do you any good during/after the civil war, did it? I’m not a historian, so I don’t know whether Texas voluntarily rejoined the Union after 1865 or was forced to rejoin. I suspect the latter. Second, the “terrorist” attack of 911 happened on George W. Bush’ watch. Third, the economy was not OK until the Democrats screwed it up. It was the Republicans – specifically Phil Gram and his wife Wendy – of Texas, no less – who led the fight to repeal Glass-Steegle, which is the cause of many of our problems today. George Bush Sr. – of Texas, again – who switched the regulatory attention away from the corporations and stopped enforcing the Sherman Act. I could go on and on, but what’s the use? I would love to see you succeed, but your game of “lets pretend we’re the prettiest girl at the dance” when you are really quite homely, is not going to win the prize you want.

Plus — I don’t very many people here that are unarmed… either in their homes or on their person. WE LOVE GUNS!

      The 10th Amendment: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

      Is there anywhere in the whole of the Constitution that grants the federal government any Power to MAINTAIN the Union in perpetuity? No.
      Is there anywhere in the whole of the Constitution that specifically denies any State to quit the Union? No.

      Even the Preamble implies the Power of secession: “…in order to form a more perfect Union…” Can any Union grow to be “more perfect” if any members of that Union cannot leave it? How can a Union become “more perfect” if membership is eternal, without recourse? Even the Bill of Rights supports Freedom of Association…So how does *forcing* association on States do anything except violate one of our Natural Rights, that exists BEFORE government & BEFORE the Constitution itself?

      Yes, We the People in EVERY State should be pushing our State governments to “put it on the books,” now & forevermore.

This is not even mentioning that your facts are all wrong. Although I thoroughly dislike Obama, it was the Bush admin that helped push our economy over the edge. First with the illegal wars, then with the bank-bailouts. Also, it was his neo-con lackeys (both Democrat and Republican) that helped reverse Glass-Steagall which essentially gave us the whole “too big to fail” fiasco and put everyone’s wealth at risk. Don’t get me wrong, I’m against government regulation in all forms, though it’s only effective in a free-market and when you cherry-pick which industries to deregulate without the balance of a free-market market system, you are basically regulating through proxy. So the abolition of Glass-Steagall wasn’t a move to deregulate, so much as it was a move to nudge regulation to favor certain interests at the expense of everyone else -no different than Obamacare.

      Moving right along, I always cringe when I hear people say that Bush kept us safe, using the reasoning that “we weren’t attacked on his watch”. Well, if we discount the attacks on 9/11 (and just forget that this major attack happened during the Bush admin), then what are we to make of the anthrax attacks? Sure we were attacked after 9/11 on “Bush’s watch” and the attack came in the form of anthrax. Of course, we could also list the massive move on our Constitutional liberties as an attack too. The Patriot Act was far more damaging to this country than 9/11 was, that is if you believe the official conspiracy theory that 19 cave-dwelling Arabs happened to get lucky over and over in the same day -completing discounting who may or may not have financed the operation, because after all -that’s not important right?

      Also, what about the Iraq war, where far more Americans died than in any terrorist attack on American soil. Should we not count that as an attack too. If not, why not? Because CNN and Fox News didn’t tell you it was an attack? What about all of the US soldiers who died in Iraq as a result of the Saudi-backed Sunni, the same Saudis that were so closely allied with Bush & Co. In fact, they were so close, that the Bush-Bin Laden owned Carlisle Group sold a big weapons shipment, allot of which was funneled right into Iraq and used against American soldiers. The Bush family profited from the sale of the weapons that wound up killing Americans soldiers in a war that the Bush family lied to get us into.

      I’m a Texan and a veteran and I can assure you that GW Bush will never run Texas through a public office, regardless of whether Texas is a part of the United States or not. I can absolutely assure you that there would be an armed resistance, though without the nanny-federal government to wipe your butt and hold your hand, those committing the crime against nature of trying to put the tyrannical Bush machine back in public office would be nothing more than ducks in a barrel.

      Almost all of your “facts” were wrong, though for the sake of brevity, I chose to address only a few. The message here, is that it makes little difference whether Bush, Obama, Clinton or even Romney resides in the White House, as they are all statist, big-government anti-conservatives who enjoy trampling on the rights of the people, while spending other people’s money to benefit a few. I could care less whether my money is stolen to fund wars and corporate fat-cats, or social welfare programs and crack-dealers, as stolen money is stolen money. Both the Democrats and Republicans support welfare, whether it’s social welfare or corporate welfare. Either way, it’s “distributing the wealth”.

      Although I philosophically agree with you and I am indeed a huge proponent of the Tenth Amendment, I don’t believe that to be the case. The Tenth Amendment doesn’t protect a state’s right to secede and unfortunately, that precedent was set in the mid 19th century with the so-called “Civil War”, though a little known fact is that it wasn’t really a civil war. Instead, it was a war for independence, which is a huge difference. A civil war, by definition, is two or more factions of a nation battling for control over the nation. The Confederate States of America didn’t want control over the United States of America, they simply wanted to secede from it. For this reason, I like to call it the “War for Confederate Independence”.

      Most people falsely believe that the civil war was fought over slavery and while slavery was a dividing issue, it wasn’t the cause for war, nor was it the sole dividing issue that lead to the secession process. Instead, the issue of tariffs was the big problem that lead the “South” to seek independence. In fact, Abe himself said on numerous occasions that if he could end the war without freeing a single slave, he would do it. One famous quote of his is as follows: “My paramount object in this struggle is to save the Union, and it is not either to save or destroy slavery.” –Abraham Lincoln

      What really caused the South to secede, was unfair tariffs on their agricultural goods that only served to benefit the “North”, at the expense of the Southern agricultural industry.

      Anyway, my point is that the “War for Confederate Independence” or the so-called “Civil War” set the precedent and thus the legally accepted limit to the Tenth Amendment -as far as secession goes (and many other things too). This is effectively the spoils of war for the victor, being allowed to “interpret” the intent of the Constitution. We may not agree with it, but nobody wants to repeat this tragic war, thus the Tenth Amendment is unlikely to be used as a justification for secession.

      The original premise of this thread is incorrect. It states “Texas Is The Only State With A Legal Right To Secede”…and that is simply nonsense! ANY State, province, region, territory, kingdom, principality, municipality, lot or block of land with inhabitants to speak for it, can secede at anytime…its constituent members simply have to decide to do so and then proclaim three things…their borders, their governance and their ability to declare war.
      The PTB would have you believe otherwise by the use of carefully crafted words on bits of paper…but its all just a ruse to fool/manipulate States into staying in unions where there is strength in numbers for purposes of trade and market dominance, resource exploitation and all the other mechanisms of this economic structure we operate within.
      So if Texas wants to secede …kewl…go for it…same goes for Pennsylvania, Arizona, Navajo or any other ‘bit’!
      If you have a look at the ideas behind what a ‘principality’ is it might lead you to some rather interesting ‘opportunities.’ Here in Australia there is a Principality called Hutt River (see http://www.principality-hutt-river.com/ ) …its a great story about one chap who figured this out some 40+ years ago…take a look…it might inspire some of you!
      A couple of years ago there was a chap here in a harbourside (expen$ive) suburb of Sydney. He wanted to make some architectural changes to his property but had to wait on local Council approval. He waited and waited and waited…and eventually got really peeved.
      So, he seceded…he proclaimed his borders , ie his lot of land, declared himself the Prince and his wife , Princess and declared a state of Emergency and Military Preparedness and warned the Local Council in writing that he would declare war should they breech his borders. LOL…bless him! Scared the ‘proverbial’ out of the Council and they bent over backwards to accommodate him and let him do whatever he wanted unhindered. It does bring up an interesting thought tho: what if he ever decides he wants to live elsewhere? The conventional route is to sell your house…but any new owner is not necessarily going to be continuing the ‘royal’ title.
      Another idea is to take a look at the concept of ‘Transition Towns’…creating off the grid, sustainable, self-contained communites means you can also create ‘currency’…and once you no longer depend on THEIR ‘money’ you really start to become SOVEREIGN…
      Rambling abit here…must be the two rums! sorry :-)

      One last thought: for those thinking of going down the ‘sovereign’ route you need to take into account that if you live in a colonized land such as USA, Canada, Australia, New Zealand and so on, and you decide to secede, you will be doing so from the State…and the State is NOT the land…that still lies under the unextinguishable ‘pre-eminent’ title with the First Nations…
      Now, I am sure a bunch of you will be bristling at the thought and will offer up the argument that the First Nations have ‘Treaty’s and that they gave up their ‘title’…but any contract lawyer would be able to pick up that the terms and conditions included in, and under which these Treatys were signed actually renders them null and void for many breaches of ‘contract law’ .then and now!

      If only things were so simple! The NDAA actually addresses “rogue states” as being threats to homeland security. Im pretty sure that the U.S. government has no intention of ever peacefully giving up such a strong and valuable part of the nation’s infastructure. There’s been wars created for less! As a matter of logic, it’s pretty likely that Texas was the first state that came to mind when they wrote that into the NDAA. The problems we as citizens are experiencing definitely would be easily solved,(For those of us residing in Texas) by cutting ties with the upcoming marxist government that is slipping into place. Is that what our founding fathers would want though? No! They would want the People as a whole to oppose tyrrany and to fight for liberty and justice for all. Thomas Jefferson even quoted,” Every generation needs a revolution.” And it takes unity to have an impact on our future. Not just as a state or a nation, but as a species.

      Actually, the moment the Federal Government choose to disobey the constitution. (Around 1913) the moment is perfectly legal for any state to get out of the Union. This is because the moment the constitution was broken, the moment the federal government became an illegitimate government.

      Conservative Republican family looking for a new State of residency. Married (before children were born), two daughters, and we have never been on public assistance. Husband is a Navy vet and has worked fulltime since graduating from highschool in 1988. Wife has College degree, small business owner, and believes parenting her children into productive, healthy members of society is her most important job. Looking for a State that believes in working for what you have, that being successful is not a sin, and that the American dream is still achievable :-)

      These are about the dumbest comments I have ever heard
      1. Texas has NASA- if Texas were to pull away from the Union, Texas would no longer be part of the USA and NASA would be moved to a new location

      3. The defense industry-once Texas leaves the Union, Texas would no longer get US government defense contracts

      2 and 14. Texas doesn’t have a Navy so the US could block the ports because the water ways would still be the US so no ships to the ports including oil ship so the refineries are useless and without the revenue from from the sale to other states the privately own companies would leave Texas

      6,8,9, 11. All of these require people once the US block the water ways and close the border the companies you mention will not make enough money selling to Texas alone, so these privately owned company will move and the people would move with them.

      So your ideas are just no well thought out Texas is a great state because it is part of without the other 49 states Texas would be no better off then Jordan one of the poorest countries in the world.
