This Brilliant Plan Will Hold Cops Liable and Accountable - and They'll Hate It!

% of readers think this story is Fact. Add your two cents.

It is not too strong today to say that law enforcement agents have not garnered the favor of the public they “claim” to be protecting and serving!

There is a growing sense in the United States that police have become too powerful and too unaccountable. The latest manifestation of this came about when a nurse in Salt Lake City, Alex Wubbels, refused to draw the blood of an unconscious emergency room patient on the orders of Detective Jeff Payne. Wubbels explained that she was only permitted to draw blood if the police had a warrant, the patient were under arrest or the patient gave his consent.

Payne responded like a man who rarely hears the word “no,” and a full-blown incident ensued. Both the detective and the nurse were in communication with their superiors throughout, and Payne ultimately admitted that none of the necessary preconditions for a blood draw were met. Nonetheless he insisted, saying, “I either go away with blood in vials or a body in tow.” Wubbels stood her ground and Payne promptly arrested her for “interfering.”

You HAVE to check out and share this video:

In the days that followed, Payne and another officer were placed on leave, and Mayor Jackie Biskupski and Police Chief Mike Brown issued apologies. Talking heads came at the topic from every angle. But an important question remains unaddressed: How should police be held accountable to the public they serve?

The topic of accountability arises against the backdrop of two Supreme Court decisions, one from 1982, and the other from 2014. In Harlow v. Fitzgerald, the court decided that public servants, including police officers, enjoy “qualified immunity,” which means that an officer cannot be held civilly liable for violating a person’s rights unless the person’s right is established “beyond dispute,” and the officer violates a clearly established law that a “reasonable” officer should know.

an officer cannot be held civilly liable for violating a person’s rights unless the person’s right is established “beyond dispute”???
How about their own CONSTITUTION! and if the 4th, 5th, 14th amendment don’t do it for you, TRY THE 9TH AMENDMENT!

Did not the Constitution establish the rights? Did not these criminals in court rooms wearing priests robes, not swear to uphold, defend and be bound by that instrument? have they not read it?

The courts are legislating from the bench and this cannot stand! There exists no authority for courts to make law! they can either find a law conforms to the Constitution or it doesn’t! THAT’S IT! THIS IS BLATANT OVER REACH!

I’m 1990 Congress changed the oath judges take , to not hold them accountable under the constitution. You need to realize that our rights are God given , not granted by a constitution, they are ours when we are born. The Government has used coercion in order to have us surrender our rights. That constitution did not do anything for the people it just listed what the government cannot do. The government has violated the terms of that contract and are no longer our lawful form of government. We have been under martial law since 1865. We need to rebuild our government from scratch using the new testament as our guidance.

that makes sense hey, use a 2,000 yr old man-made fairy-tale as guidance for actual living

As I wrote before this does not seem to be even real.

Maybe Jeff’s middle name is Max – Payne.

            Anyway, Watson I presume?

Great CONtributor Profile of Absolutely Nothing.

As I wrote I started beautifying a Buddhist Temple here with the help of the LORD, with large planters of Dokmai [ which means flower ] Trees [ the flowers on the trees bloom white ] and different colors and it has had already an effect on the Monks and those who attend the Temple.

Those who attend had let the Temple fall into darkness and were scared to go there at night due to Spirits which are everywhere really, they also treated the Temple with no respect, this has been taken care of.

The Monks who walk in the morning barefoot to say prayers and receive food for the day also travel to wakes morning and night and have little time for the upkeep its very large, the Monks also take care of stray Dogs and Cats and feed them morning and night and their is quite a few at this Temple, so it falls on those who attend the Temple.

While the Living Spirit dwells within every ones heart, all religious structures and grounds serve a purpose and God in helping you find God from within you’re own Soul.

The small door you enter is within you’re own heart, this is the door that leads to God or the indwelling Christ the Son.

By the way Andy – The Laws of God are written on you’re Heart.

          godspell,

Here is the current oath; 28 U.S. Code § 453 – Oaths of justices and judges https://www.law.cornell.edu/uscode/text/28/453
Each justice or judge of the United States shall take the following oath or affirmation before performing the duties of his office: “I, ___ ___, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as ___ under the Constitution and laws of the United States. So help me God.”

Here is precisely what was removed as evidenced by the following link https://www.congress.gov/bill/101st-congress/house-bill/5316/text
Here is what they changed; SEC. 404. AMENDMENT TO OATH OF JUSTICES AND JUDGES.
Section 453 of title 28, United States Code, is amended by striking out
`according to the best of my abilities and understanding, agreeably to’
          and inserting `under’.

1990—Pub. L. 101–650 substituted “under the Constitution” for “according to the best of my abilities and understanding, agreeably to the Constitution”.

Sounds a little different from what you said, doesn’t it!

      • 2QIK4U

Someone says this in a police harrasment video that’s old on YouTube. The cops only response was ARE YOU ONE OF THOSE CONSTITUTIONALISTS ARE YOU? While he rests his hand on his gun.

when traitors stop being hung by the neck, the country went to hell.

    • Bass_Clef

Nothing will change, nothing will be re-built, you will not overturn any system that is in place. Americans are lazy, apathetic and asleep, good luck with your pipe dreams. You have no rights, just the illusion that you do.

The narrator talks about people, who praise the police, no matter what, or condemn them, no matter what. They are praetors, militarized, though there is a traditional against standing armies, like the redcoats. In theory, the king’s guards could do good deeds. So could a slavedriver. The agents of rogue govts, throughout history, could probably rescue a cat from a tree, or help an old lady cross the street. Is that the point?

Job difficulty (~4:38) is completely besides the point of rote coercion. Sometimes, the guards of prison camps had a bad day. Should we compare statistics with mining, oil, and deep sea fishing.

They seize and turn-off the phones, kidnap and cage the people, using them. Someone exposing an armed, corrupt official, should frankly not be made to feel invincible by a picture in their phone.

At least your links work unlike mine..

Have always said these numbskulls are being trained WRONG. Made to forget the Constitution, its fellow citizens and behave, instead like Roman Gladiators out to prove the almighty State is always right.

So they like to put on a show every time they make an arrest. ON YOUR KNEES AMERICA!!

    • 2QIK4U

They’re the Pedophiles police and nobody else’s.

    • Sue Rosenorn

People have not liked police for years. Fact is the officers are getting less training, resulting in more civilian deaths.

      • Rockledge

The training isn’t what is lacking. I remember when cops were physically fit large men. Imposing men, who had natural authority.

Now, in the best interest of being “fair”, nearly anyone can become a cop. They’ve had to cut the standards so low that cops have no choice but to pull a weapon, they don’t have the natural authority to put the fear of God almighty into some street shitass who needs his ass kicked.
OR the ability to kick somebodys ass when necessary.
Cops use to be all Luke McCain. Now they are Barney Fife.
But hey, now it is fair for everyone and we are all nice and warm and fuzzy, right?

    • billybob

file a claim against their bond.

    • hansom

Whenever you’re confronted by a bully, try to remember that a bully is really a coward.
And a cop is a primate in a uniform, and a primate in fear may intend to cause harm.

    • Rockledge

The publics “growing sense” is a fabrication executed by our wonderful big brother media.
The media monolith would have us believe the public has a growing sense, but the reality is a lot of people still respect the legal system.
Other than 12 million plus however many the government doesn’t guess into the equation who are in this country criminally and those who were raised with the ghetto mindset toward cops, most americans are glad they are around.

Sadly, our media seems to want to promote evil, glorifying all kinds of deviant behavior.
