Cop Found Not Guilty for Murdering Innocent, Unarmed Dad Begging for His Life (Video)

% of readers think this story is Fact. Add your two cents.

Phoenix, AZ —  In March of 2016, Mesa Police Officer Philip Brailsford was charged with second-degree murder for gunning down Daniel Shaver, an innocent husband, and father of two. The shooting was captured on body cam footage, part of which was released the following May. On Thursday, a jury, apparently blinded by the badge delivered a verdict of not guilty and the rest of the body camera footage was released—showing a cold-blooded murder.

In October, Brailsford’s defense claimed that the prosecution showing the jury the body cam during opening statements would be unfair to the killer cop. Apparently, this strategy worked.

Jurors deliberated less than six hours and despite the horrifying body camera showing Brailsford execute Shaver, they somehow returned a not guilty verdict. This is a travesty of justice and a testament to the system that protects killers who wear badges.

Last year, an Arizona judge announced that they would be releasing the body camera footage showing Brailsford murder Shaver. When they did release it, however, the city released two videos, both of which were clearly edited and portions redacted.

Now that he’s been acquitted, the full body camera was released showing Shaver being entirely compliant with police. Shaver was on his knees, crying and begging police not to shoot him when the coward opened fire on him, firing five times—killing him instantly.

Mark Geragos, Sweet’s lawyer, called the shooting an “execution.”

“The justice system miserably failed Daniel (Shaver) and his family,” Geragos said.

Police said Shaver, a 26-year-old from Texas staying at the La Quinta Inn & Suites on a business trip on Jan. 18, 2016, had invited a couple he met to his room for drinks. No one was in any danger and the entire incident was a misunderstanding. For the majority of the video, police appear to be in a standoff with people who simply can’t hear them.

“Occupants of room 5-0-2, this is the Mesa Police,” the officer is heard yelling on the video, to which he receives no response.

“Listen to my instructions or it’s going to become very uncomfortable for you,” the officer said. “The female is to step outside the room.”

When ‘the female’ does step out the room, she is escorted away by an officer as she tells him how scared she is.

That’s when cops begin barking confusing orders at Shaver who is doing everything he can to comply. Police tell Shaver to keep his legs crossed and crawl forward, a near impossible feat. As he begins to cry from the stress and the ridiculous orders, Shaver becomes distraught and begs for his life. As he tries to crawl forward with his legs crossed, his pants appear to slip down so he moves a hand, at which point Brailsford executes him.

For several minutes, Daniel Shaver was face down with his hands on his head, all these officers had to do was to walk toward him and place him in handcuffs. Clearly, this did not happen and an innocent unarmed dad was taken from his wife and children at the hands of police.

During the trial, Deputy County Attorney Susie Charbel portrayed Brailsford as a “killer” who claimed he feared for his life to cover up an unjustified shooting.

In her closing arguments, Charbel told the jury that an intoxicated Shaver looked “pathetic” before he was killed and didn’t get a chance to know who shot him, according to AZ Central.

“(Brailsford) doesn’t get a pass because he was wearing a police uniform that night,” Charbel said.

“The last thing in the world that Mitch Brailsford wanted to do that night was shoot. His goal wasn’t to kill Daniel Shaver,” Brailsford’s lawyer, Michael Piccarreta told the jury. “Shaver is not a bad person, but his actions are what brought the police that night.”

However, if we look at Brailsford’s custom AR-15, it was clear the first thing he wanted to do was shoot.

Shaver etched “You’re Fucked” into his AR-15 police rifle — illustrating his disregard for human life.

Conveniently, however, the judge did not allow the jury to see the above photo because he felt it was prejudicial. Had jurors actually been shown the real image of this sadistic killer cop, they would’ve likely been more inclined to see the reality of the execution.

Also, it was not Shaver’s actions that brought police that night. He had committed no crime.

On January 18, Brailsford, along with several other officers, responded to a call about a suspect with a rifle in a hotel room. The ‘rifle’ was nothing more than a pellet gun that was used in Shaver’s business of pest control, and Shaver was not in possession of the pellet gun when he was murdered in cold blood by officer Brailsford.

Brailsford was fired from the department in March of 2016 for multiple policy violations not associated with the murder of Shaver. After he was fired, we learned that he should have never had a badge that night he killed an innocent man.

Aside from his unsatisfactory performance, records released by Mesa Police revealed that Brailsford was accused of beating three people a few months before he killed Shaver.

Two children and a wife will now live the rest of their lives without their loving father because of the actions of this public servant. The one thing that could help get this family closure was to see the man who stole the life of their dad and husband put behind bars. However, because of a broken system, this will not happen.

Watch the video of this execution below, do you think this was an excusable accident in which no one should be held accountable?

That’s the sickest video I’ve seen in a long time. Murder pure and simple. How’d the Mesa police ever let this guy become one of their cops? How in hǝll did a jury ever find him not guilty? Think I’ll keep out of Mesa.

    • Arte Vespule

It is unfortunate he was shot. But, having said that, he literally asked for it. He failed to listen to instructions, he didn’t do as he was told and kept moving forward and moving his hands around. He was warned, repeatedly that HE WOULD BE SHOT! And then he puts his right hand behind him quickly. When a cop is pointing a gun at you and telling you EXACTLY what to do. And warning you that he IS GOING TO SHOOT if you do not comply. You do exactly what he says. And you do everything SLOWLY. No sympathy from me…

      • Idiot Proof

No sympathy from you? Maybe that’s because you most likely have no compassion for anyone. Lots of psycho-sociopaths have a glaring lack of compassion for others, but, cry, whine and complain, louder than anyone else, whenever they feel like they were done wrong. I’ll bet you and that p.o.s. former cop have a lot in common…
At this point, aside from someone providing some good old-fashioned vigilante justice, and, shooting that p.o.s. former cop directly in his face, five times, one shot for each time he shot his unarmed, non-resisting victim, with an AR-15, the one who should be likewise held accountable, would be, the p.o.s. judge that enabled evidence to be suppressed, and, thus, mislead the jury, in as far as to what actually occurred when the MURDER was commited…

What the hell is wrong with people these days? How are people, like the p.o.s. former cop, and, this no sympathy retard so effed up in the head? Hey, Arte… don’t you realize, sympathy/compassion is a large part of what makes us “human”? No, of course you don’t… that’s why you see nothing wrong with what thiat killer cop did, and/or that fuct up comment you posted. I’d love to hear you say that crap, after having experienced what the deceased experienced, right up to the moment he was first shot… I’d bet the entire farm you would sould a whole lot more contrite, than you do in your already posted statement.

      • Just me

The cop is a sadistic @sshole, probably like you. The perp was compliant and under his control at all times. He was scared out of his wits, confused by the orders and was no danger to anyone. You or I would be found guilty of 1st degree murder. Good thing for the cop this wasn’t one of my family members.

        • Mayhem

No, Just me, the perp was reaching behind his back. Whether it was to pull up his pants or go for a weapon doesn’t matter and it was a life ending stupid thing to do while a nervous man is pointing a gun at him.

      • CTrent33

The cop has no right to order the guy to perform like a monkey in a circus. How about walk up to the guy and cuff him.

        • Mayhem

That’s fair because crawling while keeping your hands above your head doesn’t work, as any drunk will tell you, and i wouldn’t have been able to stop myself asking “So which is it, keep my hands up or crawl to you?”

What i wouldn’t be doing is making any sudden moves especially reaching behind my back so while i might get tazed for my smart mouth i shouldn’t ought to get shot.

My point is it’s no use being dead right when authority has you dead in their sights and got you dead to rights. You know, live to fight another day and shit.

          • JesusSlushies

You have no compassion or empathy. The poor guy was so nervous that he wasn’t hearing the officer correctly. Haven’t YOU ever been so nervous out of your mind that the words being spoken to you were not heard correctly?
What about that over-judgemental father or mother you must have had? Weren’t you a scared little boy? I mean, for you to be so harsh and judgemental, you must’ve been taught to think that way by someone at a very early age.

            • Mayhem

The police were called to the scene because Daniel Shaver was pointing a firearm out of his 5th floor hotel window. During the confrontation Shaver reached behind his back as if he was going for a weapon…

              http://www.fox10phoenix.com/news/arizona-news/closing-arguments-held-in-former-mesa-police-officers-murder-trial

… and based on these facts a jury of his peers found Officer Brailsford was justified in shooting Daniel Shaver.

You know, pretty much like what happened at the Mandalay Bay hotel, about a year later, just without the dozens of dead bodies.

      • st

a badge is a gold star for assholes fuck cops, NO SUCH THING AS A GOOD ONE

      • JesusSlushies

I watch Live TV and many times, when the person is being asked what’s in their pockets and then the cop says “Dont reach in your pockets, just tell me” the person STILL reaches in their pockets. My point is,that people get so worried that they do not hear the order being given when they are nervous.
No sympathy from you? Let’s see how that flies when you stand before God and you are forced to judge your actions with the same ruler that you judged others by! The outcome won’t be very pretty! You need to change your outlook and stop being so judgemental!

        • Mayhem

It’s somewhat hypocritical of you, Mrs Clippit, to claim knowledge of how it will go for me when i stand before God and at the same time accuse me of being judgmental.

Perhaps you should use sense, reason and logic when forming your arguments rather than your emotions

          • JesusSlushies

Don’t blame me.. It’s Biblical. If you have a problem with that then maybe you should talk to God not me..

            • Mayhem

Why do i need to talk to God when you are willing to speak for Him?

Show me, from the Bible, where you are given the right to criticize my parents or my state of mind when you don’t know anything about either?

    • PaulTarsuss

God bless the young man and family and grant them peace and Justice.

    • JesusSlushies

WTF happened to cause someone to call the Mesa PD??? These details are left out. Why was the woman “scared”? Im not getting the full story.

    • Pink Slime

The COP was obviously trigger happy for he had that split second realization there was no weapon and it could be clearly seen. But he had a right to be overly cautious because he repeatedly warned him not to do “funny” movements or he would get SHOT and the guy did one even worse before when he warned him and he did to that funny movement again and was SHOT.

That said, the guy crawling suspiciously also aroused the cops suspicions. Many criminals act drunk like to then SHOOT a cop to drop his guard.

All in all I can’t blame the cop in a very TENSE situation, plus he was warned an ARMED man was to be apprehended.

      • Detergent

So to summarize your view: The cop was right in shooting an obviously unarmed man, on the floor, who is complying with the cop’s directions and is doing nothing threatening – because he *might* be armed and cops just can’t be too careful.

Hope you never decide to become a cop.

        • Mayhem

Yep that’s what Pink Slime was saying alright. The very instant the perp put his hand out of sight was the green light and nowhere does the rule book state the cop has to wait till he sees a weapon.

This isn’t the wild west, Detergent, and cops are allowed to expect to get home, after their shift, safe and sound.

          • Detergent

Indeed, Mayhem, it would seem that this is the Police State West. The cop had seen all over this guy from the front and then the back while he was on the floor for over a minute. No weapon, no place to conceal one. If for some unknown reason the cop believed the deceased gentleman was carrying, the cop could have asked him while his hands were in the air, or had another cop frisk him. No need to shoot him “just in case”.

The “perp”, as you say, wasn’t a “perp” at all. He committed no crime at all. He was a plain Joe whose misfortune was to come home and be confronted by a trigger happy murderous cop.

            • Mayhem

Yeah, you wouldn’t last a week in uniform.

Obey the man with the gun because he might just shoot and you can always argue the finer points later when things have calmed down a bit.

It’s this simple the guy put his hand out of sight, period.

    • Reaper

OUTRIGHT MURDER—-TIME TO START HUNTING DOWN MURDERING COPS IN THE SAME WAY JEWS HUNT DOWN NAZIS

      • Mayhem

He was found not guilty, you idiot, so not murder just an outright killing of some guy who couldn’t or wouldn’t follow lawful commands but should’ve.

        • Hi NSA, kiss my artichoke

Gotta disagree with ya on this one Mayhem.
He was complying by laying on the floor.
What was the point in the officer ordering him to crawl forward in such an awkward manner?
Why not order him to remain still, as he was, on the floor with his hands clearly visible, and another cop go handcuff him?
The cops orders (from what I saw and heard), set this tragedy up.
And the “You’re F-cked” does kinda hint toward a premeditated line of thinking.
I hope the widow wins her lawsuit.
With 2 kids to raise, she’s gonna need whatever the lawyers end up leaving for them.

          • Mayhem

At the 4 minute mark the cop loses his rag when the guy puts both hands behind his back so it’s not like he wasn’t warned and at the 4:25 mark you can clearly see him put his right hand behind his back again.

I’d have shot him the first time.

Are we watching the same video, Arti, or do you have blinkers on?

            • Hi NSA, kiss my artichoke

When he was lying on the floor, hands out, why couldn’t a cop go cuff him?

            • Mayhem

I’ll not speculate as to why the cop couldn’t cuff him. The jury decided, as they did, based on more information than you and i currently have.

        • Hi NSA, kiss my artichoke

Just went over it again… “You listen and You OBEY.”
Meyhem… That’s the kind of stuff we put the King OUT for.
Did the cops ever think that maybe their lives wouldn’t be as in danger, if they didn’t place ours in?
That situation was handled TOTALLY WRONG… By the very people that are supposed to be there and PROTECT us.
People in the US are scared sh-tless of our police, because one can be pulled over for a tail light out… AND LOSE YOUR LIFE!
I haven’t heard of any, but, perhaps they are out there…
I would be interested to see any research as to our police forces I.Q.’s, from, say, 1950 and today.
Some have claimed that it is a LACK of training…
I believe, IT IS BECAUSE OF THE TRAINING.
The police have made themselves the public’s #1 enemy.
They have become a MONEY generating machine.
The days of the “Andy Griffith” policing, are LONG GONE.
Now, all we have is Barney shooting us.

          • Mayhem

So you noticed i’m right and now it’s all about the cop using mean words?

It doesn’t matter how the cop was trained or what the cop said the only thing that matters is a guy is now dead.

Keep your fucking hands in sight whenever law enforcement is pointing a firearm at you, end of fucking story.

            • Hi NSA, kiss my artichoke

              Never whined about mean words.
IT DOES MATTER how the cop was trained.
And what the cop TOLD the person to DO.
His hands WERE IN SIGHT, as he lay on the floor!
              Why the “Crawl to me!”
“It doesn’t matter how the cop was trained or what the cop said.”
You sound like someone at the end of a gun.
              Or brandishing it.
And really… “End of fucking story?”
Have I ever been that rude to you?

            • Mayhem

No, Arti, his hands were not in sight the whole time he was crawling and this can be seen clearly at the 4:25 mark.

            • Mayhem

There’s two things on which we do agree, Arti, namely that the ambulance chasers will get a substantial share of monies awarded in a very likely civil suit. There’s a reason, a good reason, why state officials always settle the civil suit before it gets to trial. Have a think on why that might be and impress the crap out of me by coming up with the obvious answer.

But i said two things so here’s what else we agree on, Arti, that everyone everywhere is scared shirtless of the man. Authority is meant to strike fear into the heart and command respect, often in extremely tense situations, without having to take the time to earn it.

And you think you’ve got it bad but where i’m from we don’t even need a dud tail light. Anyone, anywhere, anytime is how our Police operate and solo night patrols either wear side arms or make do with a tazer with their issued 9mm sitting in the glove box for when sh*t gets real.

    • Grim

This is why I never, ever go out unarmed anymore. Remember folks, most cops are now nothing less than murdering, torturing, criminal thugs, so in a conflict, NEVER HESITATE to use deadly force to eliminate them, before they do the same to you. F!UCK THE POLICE!!

      • Detergent

Keep in mind, that firearm you’re carrying is a “Get Out of Jail Free” card for any cop that shoots you.

    • Old Henry

Arte Vespule sounds like he’s one of those psychopathic sociopathic Nazi cops. Birds of a feather… Possibly a member of that psychopathic terrorist organization known as the Mesa PD?

Idiot Proof has a good idea, but I think it would be too quick – unless you can shoot real slow. That dirt-bag POS needs to be drug around the streets of Mesa behind a pick-up truck with a rope tied around his neck. Someone could ride in the bed and shout orders at the POS to keep his hands behind his head and DON’T MOVE or we’ll speed up!! Then hang him from a prominently located tree with a sign NAILED to his chest indicating he is a psycho murdering POS Mesa cop.

Let the crows finish off what’s left.

It would all make a great YouTube video. A nation-wide training video for would-be Nazi psycho cops.

      • Mayhem

Let me guess – i lack empathy but no one else will speak against Old Henry.

        • Old Henry

The comment did not mention Mayhem, but from the manner you defend killer cops would indicate you are one of those psychos. MYPD perhaps?

Remember them? They murdered an unarmed black guy, by choking him to death as he laid on the sidewalk wheezed he could not breathe as other cops stood and watched, for selling cigarettes.

And then there was that unarmed homeless guy (also in AZ I believe) who was gunned down for camping where the cops did not approve.

And the very young black kid who was gunned down for carrying a toy gun.

The list goes on, and on, and on. Nation-wide statistics of cops gunning down unarmed people is pretty disgusting.. It may soon become a leading cause of death among the public. Far, far more of us are gunned down than vise-versa.

          • Mayhem

On average nearly 400 people are “gunned down” by US Police every year. Heart disease and Cancer account for over one million deaths. Cops becoming the “leading cause of death among public” is a monumentally stupid thing to say.

Tamir Rice (young kid, toy gun) the grand jury decided no charges.
James Boyd (AZ camper) threatened officers with a pair of knives.
Eric Garner (cigarette seller) a grand jury and federal prosecutors filed no charges.

Now when the evidence does stack up this is what happens…

            http://thehill.com/homenews/news/363747-former-cop-found-guilty-of-second-degree-murder-in-shooting-of-unarmed-black

… which is as it should be.

            • Mayhem

And it’s not the Police that i’m defending but i guess principled arguments escape you, Old Henry, indeed no and in fact it is Article 10 of the UN Universal Declaration of Human Rights as well as the 5th & 14th amendments to the US constitution that i defend.

            • Mayhem

Speaking of empathy one of us dignified the victims by name and the other guy identified them as black or homeless.

So excuse me if i refuse to be lectured on manners by folk whose morals are so far off base they have little to no self awareness.
