Is Caitlyn Jenner headed to the slammer? The 65-year-old I Am Cait star is at the center of an investigation by the Los Angeles County Sheriff’s Department, who found her at fault for the crash that killed Kim Howe. A 161-page report has been drafted and they will present their evidence to the L.A. County D.A. on Aug. 26 and top criminal defense attorney, James Silverstein, tells Hollywoodlife.com that Cait needs to take this very seriously.

Even though a report claims that the LA Country Sheriff’s Department is not recommending jail time for Caitlyn, James tells us that there are several thing’s Cait’s legal team needs to do if she is charged with vehicular manslaughter: “If I was representing Jenner, I would hammer home to the jury the point that Jenner was driving below the speed limit at the time of the collision, and while one could technically drive too fast for road conditions while at the same time driving below the speed limit, a reasonable person would not necessarily conclude that driving in such a manner was unsafe given the circumstances. The totality of the circumstances surrounding the accident will be relevant to the jury’s determination, including factors such as what the traffic was like, whether there was adequate lighting, and whether the road was slippery.”
