Protest follows killing of man in Kashmir village

Srinagar, India (CNN) – A protest erupted Saturday in a village in northern Indian-administered Kashmir after the killing of a man by the Indian army late Friday or early Saturday.

The Indian army said the man was shot after he walked into an ambush it laid after getting specific information about movement of militants in the area. But the family of the victim alleged he had been taken out of his home by the soldiers and his body was found early Saturday.

Mohammad Shafi Rather, district magistrate in the Kupwara district, where the death occurred, told CNN that an investigation has been ordered into the killing of the man, identified as Manzoor Ahmad Magray, 24.

A case has also been registered against the army unit, he said. “The enquiry would be conducted by the additional district magistrate Kupwara and the probe report would be submitted within a month,” Rather said.

As the news of the killing spread in the village of Chogul, hundreds of residents assembled there and staged a protest.

Shouting pro-freedom slogans, the villagers carried the man’s body to a highway and laid it there, blocking traffic.

After the district magistrate provided assurances of an investigation, the villagers took the body to a graveyard for burial.

The Indian army issued a statement Saturday morning regretting the man’s death, but maintaining that “the troops had adhered to standard operating procedure (SOP) in the incident.”

The army’s statement said Magray had walked into the ambush along with another individual. After being challenged to surrender, the two started running away, at which point the troops opened fire.

“We deeply and sincerely express our heartfelt condolences to the bereaved family on this incident,” said Lt. Col. J.S. Brar, a Srinagar-based defense spokesman.

A long summer of pro-independence unrest was sparked in Indian administered Kashmir last year by the killing of an 18-year-old boy in police action in the capital, Srinagar.

There is this question, that are we all seditious in some way or the other ?
since, we all have part in stating truth and aspire for justice/truth/determination/liberty?

Therefore, when laws like anti(nation) or seditious are enacted and asserted by force or taking away basic freedom(free-will), we need to ask this question, how did that nation came into existence ?

 
Was it without being “SEDITIOUS” ?
I doubt any nation would have “yes” as answer to above question, therefore why after that nation is free by contribution of many involved communities they enact “SEDITIOUS” LAW to outlaw the very basic of justice/peace/truth/determination/liberty ?
 
Allow me the share, some thoughts on KASHMIR by Raja Mujtaba on today we are all seditious ? 
 
 
In solidarity with the Kashmiris in their freedom struggle, the people of the world who are engaged in similar movements, or have gone through the experience, stand shoulder to shoulder with them.

When Mohandas Gandhi, the god-father of India who will be revered as the leading light of its freedom movement by the present and future generations of Indians, was arrested by the British colonialists for his role in exhorting the people to rise against the British rulers and charged with sedition in 1922 in Ahmadabad, he pleaded guilty. He told the judge: “I have no desire whatsoever to conceal from this court that to preach disaffection towards the existing system of government has become almost a passion with me…”. “Sedition”, said Gandhi, “in law is a deliberate crime” but it “appears to me to be the highest duty of the citizen”.
How ironic that in a country that is enjoying freedom won for it by such people as Gandhi, who called sedition ‘his duty’ in the struggle to throw out the foreign occupiers of his land, there are people who level charges of sedition against Kashmiris who refuse to be coerced into calling themselves Indians and demand ‘Azadi’ (freedom) from India which had forcibly occupied Kashmir in cahoots with the departing British Viceroy and later annexed it into the Indian Union against the wishes of the Kashmiri people.
Ludicrously, demands are being made by nationalist and rightist groups for prosecution under sedition laws of the Kashmiri leaders and those honest, fearless, outspoken and forthright non-Kashmiri Indians of all faiths who support this cause as just.
In a seminar held in Delhi on 21st October 2010 on “Azadi (freedom) – The Only Way”, the elderly Kashmiri leader Syed Ali Shah Geelani, Arundhati Roy – a noted writer, Sheikh Showkat Hussain – Professor of Law, Varavara Roy – a human rights activist, Shuddhahruta Sengupta  and many others came to present Kashmir’s case for ‘Azadi’ directly to the people of India, bypassing the dishonest media, and give them the true picture of what was happening in Kashmir – ruthless security forces engaging in brutal killings, arrests, human rights abuses and a systematic economic blockade of the valley, all with the intent of breaking the will of the people and forcing them into submission by giving up their demand for freedom.
A point to note: the speakers who came to make or support the call for ‘Azadi’ included Kashmiri leaders, leaders representing dissident groups and major insurgency movements from other parts of India, journalists, intellectuals and activists from amongst Hindus, Christians and Muslims.
This seminar was a step in the right direction. Perhaps for the first time the slogan “Hum kia chahtay hain – Azadi!” (What do we want – Freedom!) was heard in many Indian living rooms through the TV channels. This was the first time that some people had the courage to speak up against the human rights violations in occupied Kashmir right in the heart of India. Perhaps for the first time the media was forced to carry somewhat truthful reports about what was said in the seminar about Kashmir. And perhaps for the first time many Indians realized that just as they had gained freedom from the British colonialists, the Kashmiris had the right to freedom too because they have historically been an independent state like many other states in the region and the sale of their state to the Hindu ruler by the British usurpers was an arbitrary and unlawful act that did not take away from them their right to independence.
These issues needed to be presented to the people across the country in the correct perspective and apparently the Kashmiri leaders decided to venture out for the first time to places like Delhi, Chennai and Kolkata. This will not sit well with the Indian government, nor will it suit the agenda of the nationalist and rightist parties who use Kashmiri pundits (members of Hindu religious class) to sabotage such efforts.  
The demand for Azadi being made on the streets of Kashmir is one thing, but the same call made in the heart of the capital Delhi, accompanied by shouts of ‘Azadi’, is another. This did upset many people. The seminar was sabotaged by Kashmiri pundits who desperately want the world to believe that they are the only victims of religious persecution during earlier disturbances in Kashmir and that their plight as displaced persons living in Indian refugee camps overrides the call of Kashmiri Muslims for independence. The fact is that most of them do not live in refugee camps but lead a comfortable life elsewhere and under the banner of “Roots in Kashmir” (RIK) they allow themselves to be used to counter the demand of independence by Kashmiri Muslims.
These pundits manipulate occasions such as this seminar to project themselves as victims of Muslim terrorism in Kashmir and create ruckus that would force them to be dragged away by the police under the gaze of television cameras to gain public sympathy. And then under instructions from Delhi and rightist groups they refuse to go back to Kashmir despite calls from Kashmiri leaders and the people for their return and despite assurances for their safety.
When Arundhati Roy, an internationally recognized writer and activist from South India, took the podium to say that Kashmir “is not an integral part of India”, expressed disgust over the ruthless oppression of Kashmiris and killings of unarmed demonstrators and supported the demand of the people for independence, the RSS – a radical group, Bharatia Janata Party (BJP) and a motley crowd of nationalists, rightists, extremist politicians, Hindu fanatics, Hindu terror groups, media affiliates of extremist politicians, and sympathizers inside Indian security agencies, were all up in arms, accusing her and other speakers of sedition and demanding specifically the heads of Geelani and Roy.
Many in India do not know that all mainstream Indian newspapers and television networks strictly adhere to the state policy on Kashmir and it is impossible to find a major Indian news outlet breaking away from this unspoken consensus. But the possibility of seeing Arundhati Roy in the dock was big news. “Arundhati Roy and Geelani are likely to be tried for sedition”, screamed TV channels and wire networks, “for they have demanded independence for Kashmir.”  
This was dramatics, pure and simple. There was nothing in the speeches that had not been said before by other speakers, leaders, ordinary people in the streets of Kashmir and the Kashmiri media. But the idea was to push the Kashmiris on to the back foot. This was considered necessary because the struggle and sacrifices of the Kashmiris over the last twenty years, specifically during the last three years, in sustaining the independence movement were now making a difference. Kashmir had begun to be taken seriously, nationally and globally. Indian occupation of Kashmir was being looked upon as immoral.
The intention of whipping up religious frenzy and creating an intimidating environment for Roy was clearly aimed at terrorizing and silencing her and any other Indians who might be having similar thoughts. Being a Christian, a member of a minority group, Roy is vulnerable to attacks by Hindu fundamentalists. Indian Christians have been burned alivein acts of violence as recently as the winter of 2008, just as Hindu mobs burnt alive 2000 Muslim men, women and children in the Gujarat state in 2002.
But it would have been silly for the Indian government to charge Arundhati Roy with sedition because she is known to be India’s dissident–in-chief and such an action would have aroused international condemnation, casting India’s image after China or Burma, tarnish its standing as emerging regional power and the largest democracy and, above all, bring the Kashmir issue into more international limelight.
She silenced her critics by saying (and quoting) that she said about Kashmir nothing different from what India’s Prime Minister Jawaharlal Nehru, the founder of post- independence India, had said. She argued that those charging her with sedition did not realize the irony of proving her right on that count. She lamented: “Pity the nation that has to silence its writers for speaking their minds… that needs to jail those who ask for justice, while communal killers, mass murderers, corporate scamsters, looter, rapists, and those who prey on the poorest of the poor roam free.”
As Nivedita Mennon pointed out in an article, sedition was enshrined in the Indian Penal Code’s section 124(A) by the British colonial government in 1860, with the intention to use it against Indian freedom fighters. But after the British left, the Indians retained the statute on the law books by only suitably substituting words like ‘Her Majesty’ and ‘British India’. The charge of sedition, says Mennon, means, “exciting disaffection against the government”. Disaffection, he says, means: “The absence or alienation of affection or goodwill; estrangement”. By no stretch of imagination can anyone prove that disaffection against the Indian government does not already exist in abundance in Kashmir, the insurgent states of Northeast, the Naxalite region from east to south, Tamil Nadu and Punjab by virtue of the use of draconian laws – AFSPA, and fascist tactics used by military jackboots, which act more like an occupying army. 
The central and state governments have often misused the charge of sedition to stifle dissent. But being weak legally it has mostly not been upheld by the courts, particularly because the Indian Supreme Court has established that sedition charges would stick only if speech intentionally disturbs public order and incites violence. Legal experts and political scientists have opined that ‘sedition’ and ‘contempt of court’ are out of place in modern democracy for these criminalize and stifle dissent, critique and ethical challenge to unjust order that are fundamental to free speech and democracy.
During a parliamentary debate, Jawaharlal Nehru said of the law dealing with sedition: “Take section 124(A) of Indian Penal Code.  Now so far as I am concerned that particular section is highly objectionable and obnoxious and it should have no place both for practical and historical reasons, if you like, in any body of laws that we might pass. The sooner we get rid of it the better. We might deal with that matter in other ways, in more limited ways, as every other country does but that particular thing should have no place because all of us have had enough experience of it in a variety of ways and apart from the logic of the situation, our urges are against it.” 
Nehru’s urge against the sedition law emanated apparently from, among others, the trial of Mahatma Gandhi and later, the trial of Sheikh Abdullah in 1946, the Kashmiri leader and Nehru’s friend. Sheikh Abdullah had challenged the validity of the historical basis of British rule in Kashmir by questioning the Treaty of Amritsar of 1846 under which Kashmir was bought by Raja Gulab Singh from the British. For demanding freedom for Kashmir upon the withdrawal of the British, he was tried and punished under sedition laws by the Kashmiri ruler, Raja Hari Singh.
Shivam Vij, a Delhi based writer, had this to say about the struggle of the people of Kashmir: “As an Indian I believe in the Constitution of India. I endorse the Kashmiris’ right to demand independence from India because the values of occupation are not the values of the founding fathers of the Indian Constitution. Forcing a nation to identify itself with the Indian Union is not the spirit of Indian Constitution. If the idea of India is one where the self appointed guardians of nationalism decide what national interest is and then want to see in jail those who don’t agree with that version of national interest, we must all secede from such an India. We are all Kashmiris!”
In solidarity with the Kashmiris in their freedom struggle, the people of the world who are engaged in similar movements, or have gone through the experience, stand shoulder to shoulder with them. And if the demand for freedom amounts to sedition, then Gandhi and Nehru and thousands of other Indian freedom fighters who rose against the British, and those that fought for freedom elsewhere in the world, were all guilty of sedition. As a consequence,today we are all seditious.

Importunity of KASHMIR solidarity

THE observance of the Kashmir Solidarity Day is with open message that there in no way to dilute the spiritual deep ties of Kashmires with Pakistan. SOLIDARITY Day is itself message to the world about this unbreakable divine attachment of Pakistan with Kashmir & vise verse. India utilizes all types of brutal acts & material tactics from last 64 years to break this deep spiritual relation but all in vain. Being in touch with research & as human activist aware about the facts of Kashmir freedom movement from last 33 years, have never seen Hindus against Indian illegible occupation of Kashmir . Which is enough advice misguiding Kashmires about the ideology of Pakistan. No doubt wrong can be with Pak policies but Pakistan is based on Islam.

 

Kashmir is jugular vein of Pakistan and it should not evidently abandon it under any conditions. There ought to be no ambiguity on this account. The observance of the Kashmir Solidarity Day is with appeal to remind the UNO their resolutions and an alert to India to give emphases to this human issue.

 

India had occupied Kashmir by landing its troops in utter insolence for the Indian Partition Plan and in the absence of any legal accession document. India has also backed out of its solemn pledges in the UN Security Council resolutions to provide Kashmirs an opportunity to exercise their right to self-determination through a free, fair and impartial plebiscite.

 

Rulers have to show their practical solidarity via open political, diplomatic & morally support to Kashmir’s, who after Allah have hopes with Pakistan. Rulers can concentrate on Kashmir only after ensuring peace within its disturbed areas. This is possible only via heart to heart dialogue with those angry violent people, who are against Pakistan USA policy & demand to impose SHREA Justice in their areas. If these violent people are serious in their demand they have to prove it practically via their Islamic moral values by utilizing peaceful measures & to take drastic action against those criminals involved in inhuman & anti Islamic acts like inhuman & suicide blasts in Pakistan. Here is also an appeal that if rulers will continue to impose unwanted social, political, and cultural forms upon unwilling majority of people, in disturbed areas like Fata & Baluchistan ….., the attainment of peace is doubtful. War & violence always produces sufferings, misery and thus is essentially counter-peaceful ways. As neutral human activist while updating world about state human rights violation of India , how can we ignore Lal Masjid tragedy with Babre Masjid & Golden temple misfortunes. All disturbances created in Pakistan is a great conspiracy against Pak soil, so policy makers have to deal it with wisdom & scientifically. Pakistan by drones, air attacks, demolishing houses & innocent killings in these disturbed areas can lose its credibility over showing concerns about Indian atrocities in Kashmir . As India openly mislead World & Kashmir’s about such spicy truths.

 

 Pakistan should show SOLIDARITY by utilizing approach of USA & other allies for exposing Indian state terrorism & its direct involvement in Baluchistan, Male & Samjota express tragedies. Pakistan with the help of ISI is involved against hardliners of Pakistan, but India facilitates Hindu hardliners. Throughout world via all sources it is the right time to show SOLIDARITY via expressing these realities for exposing Indian so called secularism & to aware World about the main reason behind enmity of both countries-KASHMIR. As now civilized world do realize that to avoid nuclear disaster in sub-continent Kashmir dispute is to be solved, Civilized World seems keen to address this main cause of tension between both countries. So Pakistan should plead the case, which has UNO guarantee in this forum. It is strange to observe India succeed to discuss the local Mumbai tragedy in UNO, but Pakistan do hesitate though being on legal side.

 

If we go through the history only dedicated sincere genius leaders like Quad Azam,Imam Khumani,Mandala, Maqbool,Umeer… can be able to beat cunning India . Which is bigger than Pakistan in all aspects but smaller in sincerity? For beating India big tactics are to be practiced. So Kashmir case needs attention in all aspects. But sorry even after heavy sacrifices of Kashmires  UNO is behaving like spectator ,indicates Pak weak diplomatic Kashmir policy.

 

SOLIDARITY is to encourage Islamist, sincere, dedicated genius   leadership, which can be able to unite all freedom groups under one recognized forum APHC, for one agenda & one goal. Under present disturbed & fractured scenario Kashmire leadership is not in position to change the policy of world & cunning India, unless they will not change their policies of limited group interests keeping in mind huge sacrifices of Kashmir’s, world priorities, pulse & desire of majority, problems of Pakistan…..That is their  SOLIDARITY with Kashmir.

LET ME CLEAR THE REAL SOLIDARITY IS TO UNDERSTAND EACH OTHERS PROBLEMS

Kashmir e leadership should realize the problems of Pakistan & Pakistan should feel the pain of Kashmires. That is the best SOLIDARITY with each other.

Pakistanes utilizes all efforts to provide all types of help to Kashmir’s .There are huge history of sacrifices of both for each other. Due to self desired USA pipit leaders there is gap between policies & public emotions. Friendly Islamic groups, whose role in Kashmir movement  is worth to write in golden chapter, should show SOLIDARITY by utilizing all efforts to unite leadership & to impose Islamic roles in the movement launched in the name of ISLAM. What is reason behind the countless leaders & groups in Kashmir . Keeping in mind the history, the first phase of SOLIDARITY is to unite Kashmire leadership & Pakistan should launch one firm Kashmir policy & to boost openly peaceful struggle & reject Indian dictation. It is useless to have lingering policy & to mingle minor issues with main issue Kashmir . War or peace.  Without political or material interests with Kashmir case, one can understand Kashmir dispute & can prove with solution.

 

For anti Islamic cruel forces there is only one hurdle which is JEHAD Fe sebel Allah, if any other interest involves in JEHAD, then it looses its spirit. There is not any restriction in ISLAM if we utilize all other fair tactics like dialog ETC with enemy for achieving goal. India should avail the present silent strategy of MJC & should never under estimate the power & strength of Kashmir arms movement. So it is opportunity for both countries to solve the dispute of Kashmir peacefully as per desires of Kashmir ’s, which can overcome poverty of this region & is guarantee of peace in sub continent.

 

IT IS EASY TO ANALYZE OR TO DISCUSS KASHMIR BUT TO BE VICTIM OF BRUTALITIES CONTINUOUSLY FOR 23 YEARS IS ITSELF A TRAGEDY AND KASHMIRES ARE IN BURMUDA TRIANGLE.SELF DESIRED PEOPLE IN DRAWING ROOMS WITH ALL FACULTIES CAN’T REALIZE THE PAIN OF KASHMIRE VICTIMS.THERE ARE ONLY FEW TO CARE OR SHARE WITH THE MAJORITY OF AFFECTED VICTIMS.BUT SORRY TO MENTION THERE ARE SOME, WHO IN KASHMIR, PAKISTAN & IN ALL PARTS OF WORLD ARE ENJOYING LUXURIES IN THE NAME OF AFFECTED KASHMIRES. Is there any to show SOLIDARITY by practicing check & balance in system.

 

Tragedy with Kashmir’s is that they are not only victim of Indian forces but there are also local renegades involved in open brutalities against Kashmires .SO it is duty of fair Islamist intellectuals, human activists to show SOLIDARITY by exposing India & to be with solution for problems of affected Kashmir’s. Also, should explain the difference of Afghan & Kashmir movement.

 

Priority of SOLIDARITY should be with those who,

Sacrifices their lives,

 Who are busy, disable, in jails, who were compled to migrate,In Afghan war  families of Mujahdeen were safe in camps , while as here in Kashmir majority freedom fighters are separated with their families . It is only firm Indian judiciary system which protects houses of such families to demolish. So to show practically solidarity is debatable. There are many such freedom fighters, who have sacrificed all for movement do suffer in both sides, even in  Pakistan . Though Pakistan, NGO;s .Islamic groups,….& throughout world huge relief is provided for such  affected Kashmires. This injustice is main reason for lack of trust within inner circles. Then who is to be blamed. Is their any who will show PRACTICAL SOLIDARITY by launching such system, which can trap corrupt elements, engaged openly making assets & bank balances in the name of movement? All friendly with Kashmir movement should show SOLIDARITY via uniting huge number of leaders & by launching such neutral firm Charity forum, which can provide relief to all affected Kashmires in both sides.

 

Let me conclude India after breaking APHC is busy in creating more gaps within Kashmire leadership. India after launching renegades succeed to restore their intelligence  system, & created  misunderstanding within circles, provoking affected families via pointing luxuries of some leaders, who are involved in taking bonus of sacrifices ,which  creates distance between some self desired leaders & public. So SOLIDARITY is to be fair & accept ground realities & problems of majority. Only sincere policy based on realty against India can give fruits of heavy sacrifices.

 

 SOLIDARITY of Pakistan is with Kashmir’s not with soil. It is main difference between India & Pakistan. India utilizing all cruel tactics for maintaining illegible occupation against Kashmir’s India  will have to leave Kashmir soon or later as Kashmiris are writing another golden chapter in their epic history by making supreme sacrifices with the advent of every sunup in this third phase of movement with base of Islam. So the World can no more ignore the right of self determination. India shall have to bow before the explicit will of the gallant people of the Jammu and Kashmir.

 

And Kashmir ’s will never forget the sincere support of Pakistanis & will  join Pakistan on the base of conditions after going through many phases of movement. As none can deny this SOLIDARITY is between the people who believe one ALLAH, one Prophet Peace is upon Him & one Holy Book.
