I wrote recently that the 9th Circuit Court is a circus; a kangaroo court at best. They are a rubber stamp of leftist agenda. But they really screwed up this time.
Their recent ruling on President Trump’s travel order was gross negligence on the part of a court that gets overturned 80 percent of the time. Put simply, you could ask 3rd-graders for their rulings and get a better outcome, than the 9th Circuit Court.
So in order to play “cover our butts,” the court now, on its own impetus, requests an internal vote to review its own decision.

After convening the full court on their own accord, as they expressed, the court went one step further.
Additionally, the full 9th Circuit Court now have asked the Trump administration to file an additional brief. In that brief, the court wants the Trump administration to tell the court why the three member original appeals ruling authority was wrong.
The fact is the court already know what was wrong in the decision. They know that the decision will undoubtedly be overturned. Further, the out they seek from President Trump has already been cited…by a Tweet.

The fact is that the president is exercising powers given to him from Congress. Those powers can be increased by his own inherent authorities, per this statute.
8 U.S.C. § 1182(f) allows the president to deny “entry” to “classes of aliens” he deems “detrimental to the interests of the United States.”
Whenever the president finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.
