The Impending Execution of Roger Mark Scott in Arizona

Florence, AZ—Roger Scott will have been behind bars for about 24 years. He’s condemned to death and his appeals have all failed. Prison officials are scrambling to obtain the lethal drugs needed to kill him with a lethal injection. There is a nationwide shortage of the chemicals. Very soon in perhaps a month or six weeks they will serve a Death Warrant and I know the process only too well.
Scott will be moved from Death Row to the Death House and be confined in one of two condemned cells. They will watch him around the clock and soon serve him his last meal. In daylight hours they will move him from the condemned cell walking him nearby to the execution chamber. They will strap him to the table and place an Intervenes needles in both arms. At first they will deliver a harmless saline solution.

There will be two segregated groups of people watching through a window. State law dictates what witnesses will be watching this legal process.

A.R.S. 13-705. Persons present at execution of sentence of death; limitation

The director of the state department of corrections or the director’s designee shall be present at the execution of all death sentences and shall invite the attorney general and at least twelve reputable citizens of the director’s selection to be present at the execution. The director shall, at the request of the defendant, permit clergymen, not exceeding two, whom the defendant names and any persons, relatives or friends, not exceeding five, to be present at the execution. The director may invite peace officers as the director deems expedient to witness the execution. No persons other than those set forth in this section shall be present at the execution nor shall any minor be allowed to witness the execution.

The clergy, lawyers, friends or relatives of the Scott will watch from one side.

The other side will be reserved for the Corrections Director, cops, prosecutors and the reputable citizens. In the mix of twelve are press members. Often close relatives of the murder victim are included.

Soon the window’s curtains will open, Roger Scott may give a last statement, make eye contact with some of the witnesses. Quickly thereafter poison will be pushed into his veins and kill him. Thereafter Scott’s remains will be taken to the Medical Examiner of Pinal County, Arizona where they will do the required autopsy. Relatives will either claim his remains or like so many he will be buried along side of other deceased prisoners.

On December 2, 1989 four year-old Christopher Milke was driven out to a desert wash near 99^th Ave and Happy Valley Road by Roger Scott and James Styers. Here the story varies. The little boy was shot three times in the back of his head and was abandoned by both men. They each blamed the other for actually shooting the boy.

Both men equal blame under the law and both received death sentences. They both fled the area in the same car. They both drove to the Metro Center Mall in Phoenix. Scott then took the murder weapon and boarded a city bus to the apartment where he lived with his elderly mother.

Styers stayed at the mall making a phony missing report on the boy with mall security and the army of cops that were sent to look for the child. Styers would later claim he only made the missing report because Scott threated to kill him if he didn’t.

Styers was receiving modest disability payments from the government because he was diagnosed with PTSD connected to his military service in Viet Nam. His mental issues have caused the courts to move slower as a defendant’s mental health is always at issue in the appeal process. Styers may yet escape the death penalty but that remains to be seen.

Throughout this entire case was the troubling aspect that a rogue cop, Armando Saldate manufactured a phony but somewhat nebulas confession that he attributed to the boy’s mother Debra Milke. Not only did this crime take the life of the child it also consumed half of the life of the boy’s mother in a most horrible way. Milke herself languished on Death Row in solitary confinement until just recently when she was released on bail.

Amazingly prosecutors are trying to reintroduce Saldate’s perjury at yet a second trial against Milke! That will be an uphill battle since that cop has asserted his right not to testify because of self-incrimination. That epic courtroom battle will be won or lost before Judge Rosa Mroz.

In any event Roger Scott is obviously doomed to his fate. Is he the same man he was 24 years ago? Has he made peace with his creator and learned a new respect for human life? I can’t help but wonder what benefits we will enjoy by killing this creepy guy.

I’m not particularly sad to see Scott’s life snuffed out because of his horrible crime and because what happened to the boy’s mother.

The victim’s father “Arizona” Mark Milke is a convicted felon, drug addict and suffers from serious mental health issues. Accordingly he does not fit the state mandated legal requirement of being a “reputable citizen” and cannot attend the event unless officials knowingly break that law.

The victim’s mother Debra Milke is not convicted of any crime and could attend if she whished. Somehow I don’t think she will have any desire to attend.

It’s no secret that I’ve taken on Debra Milke’s troubles like they were my own. Knowing Milke never confessed nor had a motive to kill her child has been a heavy cross on my shoulders for what seemed to be an eternity. I’ve watcher in my mind being placed in the gas chamber and later with the law change put on the injection table.

My rationale was and is simple, if I didn’t try to help this innocent woman who in Hell would help me if I were in the same position? I had a clear and present duty.

Let me also say I’m no stranger to the Florence Death House and execution chamber. I have actually sat in the gas chamber chair. I have not lain on the lethal injection table but have seen it up close and personal.

I’ve had the nightmares and the scariest of them all was when I watched as Milke begged for them to stop torturing her and get on with the execution. While traveling on I-10 I passed Perryville at least 50 times.

During the same time I’ve been at Perryville Prison doing news stories related to either Milke of other inmates there. I’d always get that knot in my stomach thinking about the Injustice done to Milke.

I expect to see Milke’s complete exoneration before Christmas or shortly after. Knowing she’s free on bail has giving me some satisfaction. Unfortunately this woman went to prison young and vibrant and came out menopausal with white hair at 49. Milke will never get those 24 years of her life returned.

Prosecutorial misconduct will be cited again and again but prosecutors are never brought to book or punished. That musty change if we are ever going to respect the right of accused Americans to a fair trial.
