Breaking News! The AZ Court of Appeals Ruled that Double Jeopardy Bars any Retrial of Debra Milke for Murder.

Phoenix, AZ—December 3^rdwas the 24 year anniversary of the arrest of and my meeting Debra Milke. She was arrested for murder of her own small child, Christopher Milke and was being booked in jail at the time.

Two creeps, James Styers and Roger Scott kidnapped the child took him out to a desert was at 99^thAve and Happy Valley road.

I’ve always suspected Christopher was molested and to cover the crime they shot the little guy three times in the back of his head. The only obvious motive to me was covering up their foul deed.

They both confessed on tape but blamed each other for the actual murder. Today they are both sitting on Death Row in Florence right now waiting to take their final walk.

Back then I was assigned by Channel 10 Television News to interview Milke at the Maricopa County Jail. I used a hidden tape recorder hoping to capture any incriminating statements about the murder of little boy, Christopher.

I had assumed she confessed so I asked her point blank, “Did you tell the police you had anything to do with your son’s death?” Milke became angry and replied, “That’s crazy, who told you that? I had NOTHING to do with the death of my son!”

Nearly a week later a police report authored by disgraced former Phoenix police detective Armando Saldate surfaced claiming Milke privately confided in him confessing to the murder.

Timing is everything. The cop claimed he got that unrecorded and un-witnessed confession just two hours before I got Milke’s angry denial on tape. I suddenly knew that Saldate fabricated the report of her confession.

For the last 24 years I told anyone that would listen that the confession never happened. I was totally convinced Milke was absolutely innocent.

Let me make it clear Milke is not my friend just an ordinary woman. I only visited her in jail as a reporter/producer for interviews.

I produced numerous news stories and documentary films for American and various European news organizations.

Debra Milke was tortured for decades with abject loneliness, despair, crappy food, broiling hot Arizona summers with no air conditioning. Additionally Milke was subjected to thousands of humiliating strip searches.

Debra Milke could be anyone’s wife, mother, sister, lover or friend. At the time of this nightmare Milke was a hard working mother seeking shelter from an abusive ex-husband, ex-convict and drug addict that was incapable of supporting his child.

Milke’s nightmare soon had become my own. I was never one to stand by wringing my hands while watching and allowing someone get murdered. That was exactly what was happening to Milke.

I always felt I should be doing more than simply producing news stories about her over the years. I lost many a night’s sleep over this horror story.

The 1989 trial defense attorney, C. Kenneth Ray somehow managed to not call me or subpoena the tape recording in Milke’s defense!

To this day the only evidence against Milke was Saldate’s lies that a jury chose to believe. Milke was convicted and sentenced by Judge Cheryl Hendrix to the gas chamber.

Times changed a little and Milke was given the option to die by a lethal injection instead of choking on cyanide gas. Finally 23 ½ years later a new trial was ordered when the 9^th Circuit Court of Appeals discovered the rogue cop, Saldate was a serial perjurer.

Quickly Milke’s supporters put up $250.000.00 bail and she was released with a strict curfew and forced to wear an ankle monitor.

Compounding prosecutor’s problems Saldate has refused to testify invoking his right under the Fifth Amendment to avoid self-incrimination. That matter was before the Supreme Court Already for review however that may be a moot point now.

I knew full well there was no case to try. I also knew that ethics or wasted taxpayer money would not prevent Maricopa County Bill Montgomery from protecting the culture of misconduct in his office. He only pressed forward with this farce of a case still demanding Milke’s execution.

The law requires when prosecutors break the law by hiding evidence and other shenanigans double jeopardy attaches and no retrial can take place. That was the posture taken by the Appellate Court’s ruling today.

Unbelievably Montgomery and his henchmen announced they’re planning to appeal this decision to the Arizona Supreme court. Because this is a Special Action it must be resolved before the date that the trial is scheduled early next year.

Milke was a vital and attractive 25 year-old woman when I met her. Today she’s a menopausal middle-aged lady with all white hair that’s been further victimized by substandard prison dental care.

I only hope Milke can salvage some kind of love life and live out her years on her own terms.

Still the government-sponsored thugs that dared to put their heavy thumbs on the sacred scales of justice must be stopped.

What must be done to end the evil culture of corruption in the Maricopa County Attorney’s office? It now should by Montgomery’s turn to face disbarment just like his predecessor, Andrew Thomas.
