Judge Stops Deportation of “Illegal” Pizza Delivery Man Detained in NY

Let me start out first by saying that the guy is an illegal, which makes him a criminal, and he was “caught”, with no identification, trying to obtain access to a US military base, which was only doing its job in stopping him for security reasons.

 

A federal judge has stepped in and stopped the deportation of an “illegal” immigrant, a pizza delivery man who was detained by ICE when security at a military base caught the man trying to enter the base.

Yesterday, Judge Alison J. Nathan of the U.S. District Court for the Southern District of New York ordered the government to show why a temporary preliminary injunction should not be granted in the case of Pablo Villavicencio Calderon, an Ecuadorean immigrant.

On June 1, Villavicencio Calderon was detained as he delivered food to the U.S. Army Garrison Fort Hamilton in Brooklyn. ICE agents took him to New Jersey.

Fort Hamilton security officers called ICE after discovering an active ICE warrant for Villavicencio in a routine background check. ICE says Villavicencio was ordered by a judge to leave the country in 2010 but stayed.

Although an illegal, Villavicencio’s wife and children are US citizens.

But the judge’s order says that the government must keep him in New York.

Now Villavicencio had been on the base before, and delivered food with no problem, but some are asking why wasn’t he caught then? Perhaps security was lax then. Anyone else has to always show identification when entering a military base, so no, he wasn’t singled out.

This will be an interesting case to follow.
