When You Have A Lot To Lose Financially, Try To Stay Out Of Divorce Court!

% of readers think this story is Fact. Add your two cents.

For most people, there is no such thing as a quick or easy divorce. Depending on the state where you reside, you may be subjected to wait times, separation decrees, and all sorts of different rules about who can get divorced, why you can divorce, and who gets what. It’s a stressful time for everyone — wouldn’t it be nice if there was a way to have a more “drama-free” split?

Although there is no magic cure, some things can be done to lessen the blow if you are getting divorced. The problem with Maryland divorce laws is that they usually involve putting your emotions, feelings and sometimes anger aside to find a happy medium that doesn’t end up consuming your time, resources and your future.

The idea behind a divorce is that you no longer want to be married to someone, which is why it is amazing that so many couples tie themselves up in court for years, unable to move along over something as simple as a Christmas decoration. If you are sure that divorce is right for you and that you will have no regrets, the best thing to do is remember why you got married in the first place and try to find those people who can work together to be apart by avoiding divorce court altogether.

Splashed across the pages of tabloid magazines around the nation are the lurid details of the rich and famous’s divorce proceedings. Getting a glimpse into their ugly lives is an American pastime. But when the average couple decides to split, they don’t fare so well, and they usually aren’t fighting over a million-dollar beach house. Those getting divorced are more likely to face poverty than their married cohorts. Taking one household and turning it into two is a hardship for any couple in today’s economy.

Don’t find yourselves in court

The best advice for a couple who is ready to call it quits is to avoid divorce court altogether. You can do that by finding a mediator who can work through the fine details of your divorce so that neither of you is hiring an attorney who is billing you by the hour. A better option is to find a way to work things out, instead of getting caught up in things that don’t matter and only end up costing you money in billable hours.

Don’t argue over the value of things

Many times people who are getting divorced feel like they are in a battle, fighting for every last cent to get their “fair share.” The reality is that a divorce isn’t fair. There is absolutely no way that you are going to walk away with half of everything and still get what you want.

The best way to come out of divorce unscathed is not to be too concerned with the value of something, especially if it is a personal item or something special to one partner. Trying to nickel and dime everything is just handing over more time and money to attorneys and appraisers. In the end, it doesn’t really matter what something is worth if it is worth something to your partner.

Many times people worry that the other partner has things and assets “hidden.” Trying to search for the golden egg and carrying out a divorce or taking them to court to find it will cost more than whatever you think you may or may not find. Try not to go by “gut” feelings about what your spouse may be holding out on; it could just lead you down a very expensive path.

Be realistic about net worth

Often couples will fight over one or another’s “net worth,” and how much they are capable of paying per month. It is very difficult to do when things are heated and you are overwhelmed, but try to be realistic. The reality is that if you are splitting into two households, then you probably aren’t going to be able to live the way that you are accustomed to unless there is additional income coming in. Being realistic about what you have and what you need is the key to not losing your shirt.

Many couples spend dollars fighting each other for pennies. Whether you are ending on good terms or not, if you want to walk away in a good financial position, you have to put your emotions aside and behave like adults. You can do that by being realistic, not vengeful, not making assumptions, and not tying yourselves to the long haul to pay attorneys and court fees that could be going to you or your children.
