Process servers

A process server requires a high level of legal knowledge to ensure that the job is completed correctly. It is much more than handing over a set of documents to someone else; it’s about making sure the process is delivered correctly in all cases. All of our process servers receive regular training and updates on changes that directly affect the way they carry out their work under recent legislation.

If the documents are to be delivered abroad, we are fully equipped to complete the job. Any country that is a member of the Hague Convention will have reciprocal arrangements for service of the document. We are constantly aware of and always work within these rules and requirements. Process service

Our process support service handles a variety of documents, from legal claims to bankruptcy petitions, claim forms, divorce documentation, and more.

There are many reasons why you should hire the services of a process server. These are the documents that we promise to serve and the process that must be followed:

Statutory requirements

This is the first stage of bankruptcy. Anyone can compile a legal claim to be served as it is not issued by the court. They can be served both to individuals and companies and is in relation to a debt. Statutory Lawsuits can be personally served or go through a process known as Substituted Service if the debtor is difficult to contact, where you confirm that the debtor still lives at the address provided, then send an appointment letter by mail confirming that they will return in a determined date and time.

If the debtor is still not on the date and can reconfirm that he is a resident at the address, he can send the Claim through the mailbox. About companies, the Claim must be left in the hands of the highest-ranking person present, such as a Director. However, if the facility is closed, the suit can be attached to the front door in a clear plastic wallet or sent through the mailbox.

Bankruptcy petition

This is the second stage of bankruptcy and this document is issued by the Court, with a scheduled hearing date.

These can only be delivered personally; however, a letter of appointment can be sent. On the return visit, if the Debtor is not available, he is not allowed to post this through a mailbox as he can do with a Lawsuit. If you are unable to serve, you will be asked to prepare an Affidavit / Declaration in Support of a Substitute Service Request which is then taken to court and given the authority to leave it at the address if you have sufficient evidence. that the Debtor still lives on the property and avoids the service.

Claim forms

This type of document can be delivered in various ways. They are issued by the Court and may be served by leaving them at the address, delivering them to another person named at the address, by personal notification to the Defendant, and also at the Defendant’s work address. They can also be left at the last known address.

Divorce documentation

This legal document would come from an attorney-client and would require personal service from the defendant. On occasion, private clients also instruct us to service Petitions on their behalf. If personal service was not possible, we would prepare an Affidavit / Statement of Attempted Delivery to be shown in court, and then they would give the authority for it to be mailed in a mailbox at the address, as long as you had enough evidence to show that the subject still resided there.

N39 Orders

This legal document must be delivered personally. It is a document about the debt, by which the court requests the debtor to go to court so that he can be questioned. This is the first part of the order and the second part is known as the commit order. This informs the debtor that he is asked to be imprisoned for a period of x number of days since he did not attend the previous hearing.

Liquidation requests

These legal documents are Business Liquidation Orders. They are attended to at the registered office of the company in question and, if necessary, they are left in the hands of a person with authority. On frequent occasions the Registered Offices tend to be in the Accountants or Attorneys companies, so the document can be left in the hands of a person named there who authorizes that he has the authority to accept the Petition on behalf of the client.

Traveler’s minutes

These procedures are related to Travelers who are invading land owned by a large company or person represented by our client Lawyer. Most of the clients ask us to go to the local court to have the documents issued with a hearing date, then go to the field and deliver the documents, handing them over to people, placing them in caravans/vehicles, and also placing them on stakes around the ground.

Service injunctions

These court orders related to gas boiler service on housing association properties or any rented property. They require service if the tenant has not allowed the service engineer access to their property to repair the equipment, much of which by law must be done at least once a year. These documents are issued by the court and must be served on the tenant. On some occasions, we find that the tenant has moved out of the property without informing the Housing Associations, so it is also a good way to verify the residence of the tenants.

License notes

These documents must be shown off-site before applying for a license to open a tavern, nightclub, or similar venue. Its purpose is to inform nearby residents about the procedure, in case they have any objection. These notices should be reviewed daily for 14 days and replaced if removed.
