Legal Aid Provider Demands Money From Families In Sanofi-Aventis Birth Defects Case
A mum is helping to raise 750,000 to fight for compensation for her disabled son. Emma Friedmann, of Highfields, Leicester, is one of 170 families in the country suing pharmaceutical company Sanofi-aventis. They believe an anti-epilepsy drug taken during pregnancy caused deformities in their babies. They have now learned they must raise the cash to fight the action after the Legal Service Commission (LSC) decided to withdraw funding. Court action was due to begin this week. As well as trying to raise cash for the court case, the families are also planning to appeal against the decision to deny them legal aid. Parents allege Epilim (sodium valproate) caused a range of birth defects, including spina bifida, heart problems and deformities of the palate, hands and feet, and that there were inadequate warnings about the possible harm to pregnant women. Andy, who has a mental age of three, suffers from autism and his development is still severely affected. Emma said: “This case isn’t just about compensation, it is about making sure there is support for my son. Parents will now be lobbying MPs for support and will consider asking for a Judicial Review of the decision from the Legal Services Commission as well as raising money.” Peter Soulsby, Labour MP for Leicester South, is backing the call for the Legal Services Commission to reconsider. He said: “The families are all very disappointed because it had got to the point where it was just going to court. Cutting funding at this stage means they won’t get a chance to make their case in front of a court.”
