Sole Conviction Reversed for Kate Steinle Killer

Social justice has achieved the last extreme of injustice. An illegal alien can shoot an American woman on a San Francisco pier in front of an audience without legal consequence at the state or local level. Previously, Kate Steinle was denied justice when her murderer Jose Ines Garcia Zarate saw all charges dropped except for unlawful possession of a firearm. As it turns out, punishment for even that infraction was too much for a homicidal five-times-deported undocumented Democrat to be asked to bear. A state appeals court has thrown out the only conviction on arrogantly absurd grounds.

The 1st District Court of Appeal overturned the gun conviction because the judge failed to give the jury the option of acquitting Garcia-Zarate on the theory he only possessed the weapon for a moment.

Here we learn that if a foreign felon possesses a gun only long enough to murder an American, acquittal is a legitimate option.

Garcia Zarate also faces federal charges; otherwise, he would be set free to kill again.

If California officials had not released him from jail 3 months before the murder despite facing deportation proceedings, Kate Steinle would still be alive.

Immigration and Customs Enforcement officials had requested that the Sheriff’s Department inform them of his release date and hold him until they could pick him up. But San Francisco’s sanctuary city policy barred local law enforcement officials from cooperating with most federal immigration investigations.

This makes the moonbats running San Francisco complicit in Kate Steinle’s murder. Regrettably, no federal charges apply to them.

When jury nullification resulted in this murderer getting off with a weapons violation, it was remarked,

Moonbattery has reduced California to a lunatic asylum without walls, run by the craziest of the inmates. The last sane Californians are advised to escape and other Americans to stay away for their own safety.
