Phoenix, AZ—I been saying it since the Ninth Circuit U.S. Court of Appeals reversed the convictions and Death Sentence of Debra Milke. Since the court referred the issue of suspected Civil Rights Violations by disgraced cop Armando Saldate for investigation by the United States department of Justice I said Saldate will never testify again on the Milke case.
It was obvious to me that Saldate now needed a lawyer of his own and that no attorney would ever let him take the witness stand under the circumstances.
Today there was a hearing and Saldate’s lawyer, Larry Debusinformed the court that under the circumstances he advised Saldate to assert his privilege under the Fifth Amendment and decline to provide testimony and any retrial. More importantly the old legal warhorse who was once a Phoenix cop himself said that Saldate has taken his advice and wanted to inform the court of his decision.
The response by Deputy County Attorney Vince Imbordino was to demand that Saldate appear in person and inform the court of this first hand. The prosecutor went on to suggest that he would argue at first opportunity to the court that Saldate must provide testimony anyway. Judge Rosa Mroz agreed that Saldate should personally appear and invoke his right not to testify on the court’s record.
Milke’s lawyer Mike Kimerer offered up that he will be bringing up the issue of Double Jeopardy against his client.
The hearing that was set on Sept 23rd for the Motion to Suppress that hotly contested confession was vacated and instead the court will hear the issues surrounding the trouble ex-cop.
