A court ruling on 26 September 2023 finds Donald J. Trump and his businesses guilty of fraud. This is a major legal blow. A New York judge has ruled Donald Trump defrauded banks and insurers across his business activities, repeatedly over the years.

This ruling confirmed and validated the Attorney General Tish James’ legal augument that Donald Trump made money amd got wealthy in business by committing fraud. The core of Attorney General Tish James’ case alledged Donald Trump was not good at business, neither was he lawfully clever, applying aggressive methods to acquire wealth. Instead, it confirmed the Attorney General Tish James’ legal argument that Donald Trump made money by committing fraud of banks and investors.

Donald J. Trump has been found liable in the New York AG’s civil suit against him.

In something of a surprise because this case was about to go to trial, the presiding judge, Justice Arthur F. Engoron just ruled in favor of Attorney General Tish James and the people of New York. Justice Engoron granted what is called a summary judgment. 

Not to make this a Criminal Law class but basically when there are no facts in dispute, there is nothing for a jury to decide, and based on all of the evidence, all of the legal motions which have been filed with the court, the court says you (all parties involved) know what is a matter of law. One party wins. There is nothing for a jury to decide. That is called summary judgment.

Well Justice Arthur F. Engoron just granted partial summary judgment in favor of New York attorney Tish James against Donald Trump. In this ruling Justice Arthur F. Engoron entered, he basically ordered all of Donald Trump’s LLCs (limited liability corporations), basically all of the different businesses which are under the Trump organization umbrella, should be dissolved. Justice Engoron ordered them dissolved, so today’s ruling is the death knell for the Trump organization. Donald Trump will no longer be able to do business in New York.

Something else Justice Engoron immediately ordered was all of Donald Trump’s business certificates, his licenses to do business in New York, should all immediately be cancelled.

The 10 corporate entities named in the lawsuit are the DJT Revocable Trust, the Trump Organization Inc., the Trump Organization LLC, DJT Holdings LLC, DJT Holdings Managing Member LLC, Trump Endeavor 12 LLC, 401 North Wabash Venture LLC, Trump Old Post Office LLC, 40 Wall Street LLC, and Seven Springs LLC, all of whose certificates must be “canceled” under New York’s general business law.

This cancellation also includes all business certificates issued to Donald Trump, Jr., Eric Trump, Alen Weisselberg and Jeffrey McConney. Basically, the Trump organization is defunct in New York.
