DePuy ASR Hip Lawsuits Move Forward with Bellwether Order, as Bernstein Liebhard LLP Continues to Evaluate Claims Stemming from DePuy ASR Hip Recall

The first bellwether trial in the federal DePuy ASR hip litigation is scheduled to begin on May 6, 2013, with a second trial to begin on July 8, 2013.

DePuy ASR hip lawsuits continue to move forward in the federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio, Bernstein Liebhard LLP reports. On December 28, 2012, the Court issued a Bellwether Designation Order, directing which two lawsuits would be the subject of the litigation’s first trials. According to court documents, the DePuy ASR hip litigation’s first bellwether trial will begin on May 6, 2013, while the second will begin on July 8, 2013. (In re: DePuy Orthopaedics, Inc. DePuy ASR Hip Recall

The DePuy ASR hip recall was issued in August 2010, after the devices were found to have an unacceptably high failure rate. Court documents indicate that DePuy Orthopaedics is facing more than 6,000 claims in the federal multidistrict litigation. Additional DePuy ASR hip lawsuits have also been filed in state courts throughout the U.S. The first trial in the nation involving an ASR hip implant claim was scheduled to start today, January 7th, in Prince George’s Maryland Circuit Court. The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hip implants like the DePuy ASR, amid concerns that metal particles shed by such devices can cause an adverse local tissue reaction in the area surrounding the implant, leading to pain, loosening of the device, and early failure of the implant. Many recipients of metal hip implants end up with dangerous levels of cobalt and chromium in their body. The FDA has ordered more than 30 metal-on-metal hip implant manufacturers to conduct post-market safety studies of these devices as part of its review.*

DePuy is involved in a second multidistrict litigation underway in U.S. District Court, Northern District of Texas, involving a metal-on-metal version of the Pinnacle Hip Replacement System. According to court documents, the first trial in the DePuy Pinnacle litigation is scheduled for September 2014.
