The U.S. government has cleared the first private enterprise, Moon Express, Inc., to land a robotic spacecraft on the moon in 2017. The decision, a first in the history of space exploration, conforms to the Outer Space Treaty of 1967, which requires private entities to gain approval from the appropriate state party. The FAA, working with the State Department, granted the permission.

oddly I can’t seem to locate anything in the Constitution that allows the US gvt to control anyone going to the moon.. anyone care to point that authority out for us??
Well actually, it does make a little since:
1- the entity can build space worthy rockets can also built intercontinental ballistics
2- there are so much “stuff” up there that sending a rocket “blindly” is dangerous (like blowing up the ISS)
3- you’d want to make sure that if something goes wrong the effects on earth would be limited (eg: blowing up nukes in space was not a good idea)
4- if they only send the probe and don’t have the rocket, they then need a space agency : meaning income, sharing of technology etc
5- the international space treaty indicates that weapons of mass destruction are not allowed (a bit of lol because I think space countries do have them) so that’s needs to be controlled.
6- any gvt would like to know what will be orbiting above their skies
7- when the constitution was written, space stuff was not really included.
It’s the same in most occidental countries.
