Why the Justice System in America is Problematic

We have just celebrated Independence Day and yet people still feel that they’re living in some sort of dreamland of illusions. The Land of the Free is not as free as the Founding Fathers had visualized it. Decades of internal strife along with a prevailing income divide has kept the country from evolving into the perfect society it ought to be.

And for sure, we can take a closer look at how the justice system has prevented the country from realizing its own American Dream. Sure enough, the concept itself is nothing but paradoxical. The issue of justice is one that isn’t inclusive. And for that, we can point out several flaws.

Rampant discrimination

The Trump administration may have inspired a new breed of ultra-nationalist sentiment, but it’s important to note that the issue of racism has long persisted in spite of mass movements that have gained some measure of success in the past decades. And yet, we all have to admit that the issue of discrimination in this country is systemic. Law enforcement and the courts themselves feed on this notion of racial superiority.

So how do we address this? Well, it’s not enough to appoint more black judges. The issue should very well be anchored on the need to educate younger generations about the reality that discrimination presents and the fact that it doesn’t fit modern narratives.

Corruption and conformity

The problems that maintain systemic discrimination are also sustaining the conditions that allow for the abuse of power. Seeing as though the justice system itself is exclusionary in that it only favors those whom society sees as more deserving of justice, it’s difficult to imagine beneficent authority figures who can fulfill their mandates without due prejudice.

The imbalance in law enforcement priorities has only succeeded not in keeping neighborhoods safe but creating the very conditions that allow for the abuse of power.

Access to legal expertise

There is, at least, a silver lining to the decrepit state of the justice system. As enshrined in the law itself, people are provided better ways to defend themselves for infractions and crimes of a graver nature.

Sure enough, North America has not turned its back on justice. In Canada, for instance, McQuarrie lawyers have been at the forefront of defending people suffering from personal injuries. There are also local law firms across the United States that cater towards people who need protection from unfair labor practices as well as the damage dealt by law enforcers themselves.

Then again, you can’t always expect a perfect harvest from every apple tree, as there are lawyers who prove to be rotten to the core. State bar associations have tried to address this issue with some level of success.

A better future on the horizon

In spite of all these imperfections, people are confident that the best features of the American justice system would be given more focus. The goal right now is to resolve historical wrongs, end the systemic discrimination that’s eating away at the American dream, and resist all the bad that has made the justice system into what it is today!

So long as there’s resistance there’s hope.
