Seeking Legal Malpractice Law Firm

We are seeking a Legal Malpractice Law Firm. Please read the following synopsis and, if you’re interested, contact me for full research and documentation.

The lawyers who were handling our medical malpractice case would be the defendant in this legal malpractice lawsuit. Here is a bullet point summary of our experience with Gunn Law Group.

• Gunn Law Group was first contacted in March of 2018, contracts were signed and a lawyer was assigned to the case.

• The lawyer assigned to the case was Elizabeth Lanier. She had been an RN before she became an attorney, and understood medical information we provided to the Firm. After Attorney Lanier read our research, Gunn Law accepted our case and filed a 90 day extension. Case Number 2018ca1007 Date of Filing 4/20/18

• We later discovered, in a letter dated June 18, 2018, that Attorney Lanier went on vacation, returned, and left the firm to work for another law firm, defending insurance companies. The same letter also stated that Mr. Gunn was going on vacation and said we could contact his assistant while he was gone.

• Communication with Gunn Law Group was hit or miss from that point forward. We sent e-mails and made phone calls asking for updates and got no response except for verbal reassurance by a paralegal: “Don’t worry; there is still plenty of time.”

• I was informed by a phone call from Gunn Law on July 12, 2018, that two attempts to find an expert witness finally were made before the statute of limitations was due to expire. Their two attempts to recruit an expert witness may have been incomplete.

• We have no evidence that the experts whom Gunn Law did contact had read all of the research we provided to the firm. That research had been compiled by a retired MD who now does forensic analysis of medical records for lawyers. Our forensic expert indicated we had a strong case.
• It appears that Gunn Law also may not have encouraged their potential expert witnesses to review and incorporate into their decisions the standard of care research we provided concerning our experiences and treatment at Physicians Regional Hospital.

• As far as we know Gunn Law made no further attempts to find expert witnesses or that any other such work was done (at any time) on our case. It appears that the potential expert witnesses the Firm finally did contact were not allowed enough time to properly review and digest the voluminous records and research material we provided.

• We had told Gunn Law that, following my stroke injuries, the Veterans Administration had declared me permanently and totally disabled with full benefits, effective August 1, 2017. From our current perspective, neither the newly assigned Gunn Law attorneys nor any of their prospective expert witnesses seemed aware of that fact

• The next contact from Gunn Law was a letter we received on August 20, 2018, informing us that the case had been dismissed because the statute of limitations had expired on August 12, 2018.

• We question the due diligence, timeliness and sincerity of Gunn’s last minute efforts. We easily found at least two other apparently qualified experts ourselves the week after the case had been dismissed.

• We believe that we were not effectively represented.

• The medical evidence is well established and should not be a significant issue.

Dr. Sewell is a life member of MENSA, so the psychiatrist was interested in providing evidence of damage to Dr. Sewell’s cognitive functions. She requested that we not reveal her name until agreements have been signed.

When we informed our expert witness that we had not yet found an attorney for the legal malpractice case, here is the advice she gave us:

“Oh dear. I think the problem is not so much in the validity of your case, as it is finding a lawyer who is willing to go up against other lawyers.

“You need an aggressive maverick type lawyer.

“I suggest you go through all the Florida Bar lawyers who specialize in legal malpractice until you find one willing to take it on.

“Maybe you need someone a little farther away from the Gunn firm – in another city – so they would be less concerned about taking them on.

“I think you have a better chance the farther away they are.

“Good luck. Let me know when you find one.”
