Update on the Amicus Brief!

“We the People of Arkansas must stand up when our rights are being denied so that the powers reserved for us, and future generations, cannot be overthrown.”

On April 4, 2024, We the People of Arkansas filed an amicus brief which basically states that “the legislature has overstepped its bounds, creating laws that cause irreparable harm to the citizens of Arkansas.”

Additionally, the brief states that We the People believe that two 2023 laws are unconstitutional, as:

• they require proposed ballot measures to be approved by the state attorney general AND for canvassers to gather signatures from 50 counties instead of the constitutional requirement of “at least 15 counties”.

Going from requiring the gathering of signatures in 15 counties to 50 COUNTIES is ridiculous!  The legislature is clearly trying to weaken the ballot measure process that was enshrined in Arkansas law. If it stays this way, the initiative process will be dead.

The initiative process BY the people needs to stay intact and NOT taken over by huge corporations that have millions of dollars available to pay for signature gathering!

Once again, follow the money!

Thankfully, on May 2, 2024, the Arkansas Supreme Court accepted our amicus brief challenging the two 2023 laws. (Thank you!)

The lawsuit hasn’t been dismissed! 

They will make the final decision with the amicus included in the documents. No oral arguments will be allowed, so the amicus is even more important.

Tanya Charlton of NW Arkansas is quoted as saying, “I am pleased that the judges accepted our amicus brief. Oftentimes, we feel ignored and rejected by our elected officials and representatives, so this feels like a small win for The People.”

Secure Arkansas wholeheartedly agrees.
