Army Master Sgt. C.J. Grisham Illegally Disarmed And Arrested

On March 16, 2013, my son and I were hiking along country roads among pastures and fields with my 15-year old son to help him earn his hiking merit badge. I always enjoy these father/son hikes because it gives me time alone with my son. As I always do when we go on these hikes and walks, I took my trusty rifle with me as there are coyotes, wild hogs, and cougars in our area. In Texas, it is legal to openly carry a rifle or shotgun as long as you do so in a manner that isn’t calculated to cause alarm. In other words, you can’t walk around waving your rifle at people. I always carry my rifle slung across my chest dangling, not holding it in my hands.
At about the 5 mile mark of our hike, a voice behind us asked us to stop and the officer motioned for us to approach him. He got out of his car and met us a few feet later. He asked us what we were doing and I explained that we were hiking for my son’s merit badge. He then asked me what I’m doing with the rifle, to which I responded in a calm manner, “Does it matter, officer? Am I breaking the law?”
At that point, the officer grabbed my rifle without warning or indication. He didn’t ask for my rifle and he didn’t suggest he would take it from me. He simply grabbed it. This startled me and I instantly pulled back – the rifle was attached to me – and I asked what he thought he was doing because he’s not taking my rifle. He then pulled his service pistol on me and told me to take my hands off the weapon and move to his car, which I complied with. He then slammed me into the hood of his car and I remembered I had a camera on me (one of the requirements of the hiking merit badge is to document your hikes). This video is the rest of that encounter. Up to this point, I am not told why I am being stopped, why he tried to disarm me, or even that I’m under arrest.
We did not set out that Saturday morning to “make a point” or cause problems. Our goal was to complete a 10-mile hike and return home without incident. My son chose a route that away from populated areas but near our home.
The arresting officer is Officer Steve Ermis and the supervisor is Sergeant Minnicks of the Temple Police Department.

        Look , ok we have gun rights, a CCW permit the right to bear arms and so on, But any one with an ounce of brains left in there head would know better than to walk along a highway with a semi auto AR 15 clipped to a strap around your neck. CCW means the right to Carry a Concealed weapon the key word is Concealed not Exposed Weapon, Don’t get me wrong I’m all for gun rights I have a CCW and carry most all the time without anyone noticing I’m good with it fast and accurate I been shooting for over 30 years now, you won’t see me walking around dressed like that, all that’s going to do is have the State Police do what they just did and find a way to revoke his CCW lic…..and keep his AR15… Bummer for him.       Steve Ermis fits the definition of a violent predator. This type of fascist really should not be allowed to carry or posses a gun, let alone be a cop.. In my opinion, Ermis is a danger to society and a poor reflection on Sergeant Minnicks and the Temple Police Department.
      May this constitution-hating thug he be sent to prison for tyranny. Of course that won’t happen as cops generally protect cops, no matter what the crime.

      Im so glad I read your account of the story because i really think you were wrong. The cop wasn’t completely right but as someone in the armed forces you should have known better to answer differently. If what you were doing wasn’t illegal why did you question the officer? These guys see the world changing and their lives are in danger too, what you did was stupid.
      And really with everything out there on hoe crazy military guys are I don’t think you should be allowed to carry guns when not on duty.

If a man has not voilated the law and in fact is in the process of having his CONSTITUTIONAL RIGHT VIOLATED , he has every right to tell it like it is and really to defend himself. This is the whole point , the police abuse there TAXPAYER GIVEN POSITION and regularly violate citizens civil right , constitutional rights. You will soon see where this conduct leads.
        You need to read your constitution and the circumstances leading up to it being penned…
        Washington, Jefferson, Frankiln ect..those men had foresight and knew this would happen if we allowed it.

I’m truly sorry you, your son the laws of Texas and the United States of America sacred Constitution were abused and for this you should be compensated and “We The People” deserve and demand JUSTICE on this matter. With the way the cop reached for and grabbed your weapon in a very aggressive manor and without asking you for it or telling you why he stopped you constitutes grounds for you to have pulled the .45 and shot him dead.       I don’t have any extra $ to help , but this is the type of police state action that will result in civil disobedience and eventually armed confrontation between civilians and police state type cops.
      Seems to be a lot of power trip cops in Texas , interesting because it is clearly a pro 2nd ammendment state . These cops really need to read the constitution and call to mind the circumstances under which it was written. They will soon be facing a decision of what side they will take . My guess is many will be reminded of the toes they stepped on during their police state power trip.

      So, really both sides are guilty here. First, when a police officer approaches a man with a gun – and there is a child with him, the cop knows nothing about him. The cop needs to consider whether the child is safe. The cop doesn’t know the child is the man’s son.

      I think that if the father didn’t act like an idiot, that he would have been given his guns back and he could have went about his business. But the father over-reacted here. The cops did not use excessive force – which some cops are blatantly guilty of.

      So, if you are walking down the road with a rifile (Yes it’s legal in Texas – OK – but really, are there hundreds of people walking down Texas roads in Texas toting rifles? Really, are there?) a police officer has a duty to ensure safety. That’s their job.

      So a police officer first and foremost has to ensure safety – mostly for themselves. Then they need to verify whether the person carrying the weapon has a permit to do so (he also had a concealed weapon – yes, WITH permit). Then he needs to verify the person is wanted or has any warrants.

      This case will be thrown out – no one will be sued – and the father can strut around like a Banting Rooster.

      If carrying a rifle in public was legal in my state (I live in FLA – not sure) and I saw someone walk down my street in front of my house where my kids play, damn right i would call the police. I don’t know what they are going to do with a firearm. Once they check out OK, then great. Carry on.

      While I am all for law enforcement , it goes both ways, and if, which is quite apparent, the cop was in violation of the law, he should be treated like anyone else, arrested, tried, and convicted. That scum-bag is NOT the law, as many believe, he is supposed to enforce it only, which he is in fact violating. If that cop had an ounce of manhood, he would be in the military, willing to sacrifice his life for his country, instead of being a weeny and expecting high wages as a cop, with the COWARDLY mentality that they just want to get home safety. Where is all the false bravado that they try to impress us with? Love to see this cowards in the justice system being ‘counseled’ by BUBBA.

      When he asked you what you were doing with the rifle, instead of giving an evasive answer why didn’t you just explain your self in the first place, any officer who plans on going home to his wife and kids is going to go on the alert with a response like you gave, anybody can bash cops and use typical “cops are bad, cops are bad” type phrases but what does your initial response tell your son about how a law abiding person is suppose to speak to a law enforcement officer who is asking pertinent question to his own safety.

      Regardless of whether or not carrying a gun is legal or not in your state, in the state of this society these days and in light of all the horrible shooting that are happening in this nation, I think an officer asking a question about a rifle that is being held by any individual is appropriate and rational, how many people would be screaming for the officers job if he were not to stop another individual who was carrying a a gun and walked into school yard and began shooting people????

      DOES IT MATTER? Not the smart thing to say to a police officer. The ‘soldier’ appears to be putting on quite the show for his son. And is acting like a punk. Where was his military bearing? Lost it.

      He was irked. I would be as well (I am a retired military). But I do believe I would have answered his question, then asked what is this all about. I would not have ‘challenged’ the police, which is what he did. Plain and simple.

      Judging from many of the comments below, there are a lot of police haters reading this story.

      Had he only not challenged the officer, and put on a show for his son (hiking for an Eagle Scout), this would have been a non-story. Next we will hear that he suffers from PTSD. He also does not appear to meet the height weight standards of the military ( a tad overweight).

        It is none of the cops business. The man was within his legal rights, he was in the country. He was not breaking laws or creating a disturbance. The cop is the true criminal here. You have no obligation to answer or talk with a rouge cop. None. They can arrest you because many are corrupt and hate the constitution, but that is another matter.

        Where I live we are “allowed” to wear side arms in public, on the streets, in businesses (if the owner allows) and the cops respect that. This criminal cop in the video would have been shot in my state, not by me, but by someone totally within their rights to defend themselves against a terrorist cop.

      If it was legal to carry the weapon, there should be no reason to stop him in the first place. The cop could have asked to see his permit to be sure and that would prolly been the end of it.       Please arm yourself wih the knowledge of the laws of the city, county and state where you live. Also, learn the practices of the police in your area. Get the names and badge numbers of those individual, check their history of active duty incidents that MUST be put into their file. We only have 1 police officer for where we live, so that’s pretty easy to figure out.

      we MUST defend ourselves with the truth and the justice system to our advantage. Do not consent to any searches of either your person or anything that you may be carrying. Use the law to your advantage like Master Sgt. Grisham has done.

      There was no probably cause, no suspicion of any wrong, etc.
      They simply are ARROGANT — that’s why so many people get an attitude about cops.

      The officer later says it is okay to do what he did “if it alarms people”.
      The man wasn’t doing anything wrong — simply walking.
      Sorry, officer, but you cannot violate Constitutional rights just because they offend others.
      If someone says it “alarms” them for you to carry a black backpack because they think you too could be a terrorist, does that mean they can detain everyone with black packbacks all across America & seize them even if there’s no bomb or illegal substances in them?
      What about your freedom of speech? What if that “alarms” someone — can the govt refuse to allow freedom of speech if someone simply disagrees & says it is alarming? Nope.
