Chicago Judge Rules Gun Ban Unconstitutional. The 2nd Amendment Shall Not Be Infringed

A U.S. District Judge ruled that Chicago’s ban on the sale of fire-arms is unconstitutional but left the door open for the city to appeal by issuing a temporary stay on his ruling that effectively leaves the ban in place while the city is given a chance to appeal.

U.S. District Judge Edmond E. Chang said in his ruling that “While the government has a duty to protect its citizens, it’s also obligated to protect constitutional rights, including the right to keep and bear arms for self-defense.” However, Chang said he would temporarily stay the effects of his ruling, meaning the ordinances can stand while the city decides whether to appeal.

Chang is a federal judge appointed by Obama and NRA spokesman Todd Vandermyde responded by saying,

“The fact a federal judge appointed by President Barack Obama “ruled in favor of the Second Amendment, shows how out of step and outrageous Chicago’s ordinances really are.”

The lawsuit was filed by the Illinois Association of Firearms Retailers and three Chicago residents and challenges that because the ban covers federally licensed firearms dealers, and gifts among family members it is unconstitutional. Judge Chang agreed and said;

The city goes too far in outright banning legal buyers and legal dealers from engaging in lawful acquisitions and lawful sales of firearms, and at the same time the evidence does not support that the complete ban sufficiently furthers the purposes that the ordinance tries to serve. The Obama administration moved on two fronts Friday, January 03, 2014 to preserve the National Security Agency’s controversial spy programs, appealing a major ruling against the agency while winning permission from a secretive court to continue collecting Americans’ phone records. The request to keep collecting phone records was made to the Foreign Intelligence Surveillance Court. These requests are made periodically — and have been made public ever since the NSA controversy erupted last summer — but this would be the first since two conflicting court decisions about the program’s legality. The FISA court approved the request.  The Justice Department on Friday also appealed the ruling of a federal judge who, in a major rebuke for the administration, said the National Security Agency’s data collection likely violates the Constitution. In its brief court filing, the department said it was appealing to the U.S. Court of Appeals for the District of Columbia.  Source: Fox News
