Citizens For A Clean Pompton Lakes Urges the USEPA (United States Environmental Protection Agency) to Kill DuPont’s Request to Weaken Vapor Protections for the DuPont Pompton Lakes Works site in Passaic County, NJ.

The USEPA’s willingness to consider this without any public process is just salt on the wound!

Pompton Lakes, NJ - The Citizens for a Clean Pompton Lakes is very disappointed to hear that the USEPA Region 2 Administration is even considering DuPont’s request to weaken the contamination levels that were set in 2008 within the Vapor Interim Remedial Measure Work Plan for the plume and barrier contaminated areas within the Borough of Pompton Lakes, NJ. USEPA has not yet rejected DuPont’s scheme. We are particularly alarmed that USEPA would even consider such an action can take place without holding public hearing. The USEPA and NJDEP (New Jersey Department of Environmental Protection) are currently reviewing DuPont’s draft 2014 vapor intrusion work plan.

Our organization is demanding the following step be taken by the USEPA:

Since DuPont site is being cleaned up is under the Federal Law “RCRA Corrective Action”, the RCRA CA program is the responsibility of the USEPA. The NJDEP HAS NOT received delegation of the RCRA CA program from the USEPA; therefore, it is under the full jurisdiction of the USEPA. Any substantive changes to the DuPont RCRA CA permit requires public notice, opportunity for public comment, and a public hearing under federal law. A change to the Vapor Intrusion Screening Levels in the DuPont RCRA CA permit would be highly substantive. In the event that the USEPA makes the wrong decision to amend the DuPont RCRA permit to change the Vapor Intrusion Screening Levels, that change must be done formally via permit modification procedures, which include a public notice, opportunity for public comment, and a public hearing.

We are gravely concerned that the USEPA is obfuscating these issues by creating the appearance that the NJDEP changes to New Jersey State program are somehow binding on the USEPA. We believe the USEPA is misleading the public by not advising the public about the legal requirements under RCRA outlined above. In a recent letter to a Pompton Lakes resident, the USEPA called the Vapor Trichloroethylene (TCE) and Tetrachloroethylene (PCE) Screening Levels being considered for an increase by the USEPA as “comparative levels”. The residents involved in our organization were not born yesterday and this referral is condescending, misleading and insulting.

The obfuscation and misleading statements being made by EPA within this correspondence are totally unacceptable. We demand a better representation from our United States Environmental Protection Agency (USEPA) for the residents of the community of Pompton Lakes, NJ. Upon complete of the review of DuPont’s request to raise the action screening levels for Trichloroethylene (TCE) and Tetrachloroethylene (PCE) any changes to DuPont’s vapor intrusion program must be communicated to the community by the USEPA, NJDEP and DuPont.
