Passing S.J. Res will also limit the EPA regulatory action.

Subject: Pass S.J. Res 37 to Disapprove of the Utility MACT Rule

 

I urge you to save American jobs by supporting S.J.RES.37, Senator Inhofe’s Resolution of Disapproval of the EPA’s “Utility MACT” regulation.  If implemented as planned, this rule will jeopardize the reliability of America’s electricity grid, cost hundreds of thousands of jobs, increase energy prices, and degrade America’s economic competitiveness.

 

This regulation is the most expensive rule that the EPA has ever issued against the power industry.  If implemented on schedule the rule could have very real and detrimental impacts on the reliability of America’s electric supply and raise the costs of energy for American businesses and families.

 

The Utility MACT rule will affect everyone that relies on affordable and reliable electricity to do business and conduct their livelihood.  If this and other EPA rules are not sensibly implemented, NERA expects lost jobs – on average 183,000 per year as a result of Utility MACT and EPA’s pending clean air, coal combustion residuals, and cooling water regulations. The EPA’s onerous regulations have already prompted the announced shutdown of over 25,000 megawatts of coal-fired power plants – that is enough to power approximately twenty-two million households.  Many thousands of jobs are imminently at risk if you fail to stop Utility MACT.  

 

Now is not the time to be compromising our fragile economy.  The negative impacts of these rules can be mitigated through a sensible delay to their implementation.  It has been estimated that the average family will lose $270 per year of disposable income from pending EPA power plant regulations.  In fact, EPRI recently found that electric utilities and their customers could save $100 billion through 2035 if the EPA simply provided two more years to comply with EPA rules.

 

The Administration has refused to take action on this issue, denying a request to simply grant utilities a reasonable amount of time to comply with the new rules. Utility MACT will require power plants to be shut down, significantly modified, or replaced, and for gas pipeline and electric transmission infrastructure to be built.  Making these sweeping changes to business operations is a long-term process that requires more than just three years to accomplish, especially given the regulatory hurdles that will undoubtedly impede such efforts.

 

A successful Resolution of Disapproval may be a strong remedy, but the negative impact on our economy and jobs if the Utility MACT rule goes unchecked will be far greater.  Moreover, the EPA will still be able to issue new, more reasonable mercury-only emissions standards for power plants, and the additional time would also permit Congress to address power plant mercury emissions through its own legislation.  

 

The American consumer, labor unions and the business community all agree that the requirements of this rule must be delayed.  I urge you to listen to their concerns and support Senator Inhofe’s resolution.
