YouTube & copyright school denies Fair Use rights to videographers

Yes I was finally declared a pirate by YouTube and was given a major strike on my account, the very thing that led to this was a educational and encouraging video showing two different excerpts from Star Wars Episode III, two minutes in total, showing the Jedi fighting the Sith and compared it to the New World Order encouraging people to fight the New World Order, in a peaceful manner of course. Whenever the strike got put on my account I decided to counter the YouTube Content ID penalty by declaring I was protected under Fair Use because since I added my comments in the video in the form of non-verbal words encouraging people to fight the New World Order agenda by Herbert Walker Bush, that using two portions in only a 2 minute and 35 seconds of a movie over 2-hours so you would think that would be Fair Use under Copyright law. Apparently 20th Century Fox and YouTube doesn’t think so!

USWGO Received their first DMCA complaint after I was legally threatening 20th Century Fox with a lawsuit for violating USWGO’s Fair Use rights under Copyright law. Even though I could not afford the legal fees a legal threat is all I could do to get them to back off from infringing my rights under Fair Use Exemptions under Copyright law.

It uses less then 2:30 worth of video which is considered a fraction and not the heart of the material plus George Lucas has never had a problem with my uploads before this Content ID Crap. Alex Jones has used the old star wars music intro for his GCN radio show for over 10 years now and never got in trouble. This video is meant to educate people to fight the new world order similar to the Jedi fighting against the Sith takeover of the republic to create a elite empire. It’s no secret everyone who has bought Star Wars know how it ends and compares it to America in it’s bad situation. This video is only meant for political, educational, inspirational, and social justice purposes. This does not harm the movie industry as many can’t see usage of a piece of a over 2 hour movie cause such trouble. This video is fully protected under Fair Use and my friend who is a copyright attorney who helped defeated Righthaven, can vouch for me if he needs to but I am sure you agree with my Fair Use rights under copyright law, right??? I am not intending any harm, trying to educate people politically using a portion of a Star Wars scene which is not the heart of the whole thing, this piece of the whole film is not going to ever cause any market harm and I promise it won’t in fact this gets people that are against the new world order to buy your movies through free advertisement thanks to my excerpting, and then it’s for a political purpose and I am not competing at all against Fox movie entertainment therefore USWGO YouTube channel is 100% within Fair Use, if I go in front of a judge or jury I will win under the facts and the law and can then countersue at will as the prevailing party for hurting my YouTube account and causing less people to be able to view my video uploads and causing YouTube to penalize my upload limit over 15 minutes makes it where I cannot even upload exclusive material that I created myself just because of videos like this one I did years ago. Please cease and desist your claim against this video and allow my legal Fair Use of the work.

Then after I received the warning I was forced to endure Copyright School and received my first DMCA strike against my account. All comments against the New World Order and other type comments were all erased. I got a permanent strike against my USWGO official YouTube account until I go to court and send a DMCA counter-notice to 20th Century Fox.

The Fox corporation is the least of my concerns. The Copyright School teaches nothing about Fair Use and that all uploads have to be 100% original leaving out the right to Fair Use, the right to comment on copyrighted material, the right to excerpt it in news and political videos while crediting the original copyright owner which is George Lucas and Star Wars Episode III, the right to use a portion as long as it is not at the heart of the material, and I do not compete in the same Arena as Hollywood movies so that very video under USWGO would be Fair Use no problem. YouTube’s Copyright school leaves out Fair Use which makes you wonder if YouTube is gutting Fair Use once and for all. That they are tired of all the Anti New World Order and Patriot videos out there so they are trying to remove them all now using the automated Content ID system.

There are good reasons warranted for why Content ID is needed to combating online piracy using free streaming media upload websites but coming after Fair Use and making people kiss the butt of big media corporations that probably love the New World Order was never the intent of the Content ID system or Maybe it was? Google has already proven to be a NSA front organization which shares users data with the NSA. Google now owns YouTube and has owned YouTube for years now. They have been knowingly censoring anti-government videos and videos critical of government but not anti-government. This new trend of corporate censorship isn’t just on YouTube. It is now known that Facebook and Dailymotion also uses similar Content ID systems.

With Content ID Fair Use is threatened because then every copy of a copyrighted video even very small portions of excerpted copyright material(15-30 seconds, 60-120 seconds, 120 to 180 seconds) is treated as copyright infringing material. Even with Endgame: Blueprint for Global Enslavement even 30 seconds was penalized under YouTube’s Content ID system. Even when I declared Fair Use which uses 2-3 times less excerpting then even the Star Wars Episode III excerpts, and eOne denied my Fair Use rights and I was told I have to send a DMCA counter-notification just to have the Fair Use rights to use even 30 second of material. That also means I will have to be summoned to a court trial, despite the hardship it would bring on my disability, just to fight for my rights under the Bill of Rights which is why the Congress enacted Fair Use exemptions under copyright law in the 70′s because the route this would take is that news reporters, commentators, Documentary Filmmakers, Article writers bloggers, protesters, town councils, and others can use excerpts of copyrighted material if certain guidelines are taken into account. The stakes are higher for Fair Use for those that don’t make money off of the small excerpts of copyrighted material and those that don’t compete financially with the businesses that put out the copyrighted material that someone excerpts from if what I am reading from the copyright law is correct.

Here are some of the questions YouTube asks. They even state that all content has to be 100% original in violation of peoples rights of using excerpts of copyrighted material under Fair Use of U.S copyright law, Fair Dealing of Canadian copyright law, and other countries similar Fair Use type exemptions.

As what was described in the Copyright School question manifesto, Fair Use was not included nor was it intended to be included so anyone under Fair Use is now a copyright pirate until they throw thousands of dollars of their own money in court costs to prove that Fair Use still exists.

This is the list of questions that was asked of me. All I know is the four because I didn’t have screenshots of all of them is there was more then four. I do know none of the questions I asked in Copyright School was regarding my personal and news reporting rights under Fair Use.

1. The following item(s) may be protected by copyright: music, photographs, paintings, books, films and video.
2. If the original creator of the copyrighted work has died, the work is no longer protected by copyright: Copyright protection can continue even after the creator’s death.
3. Creating 100% original new content for YouTube will help to protect you against claims of copyright infringement: If you aren’t copying anyone else’s work, you have nothing to worry about! (No Fair Use Huh!)
4. Copyright infringement can result in: Monetary damages (Fines), Legal fees, Termination of your YouTube account, and the answer was all of the Above.

The Copyright clause under the U.S Constitution was not meant to conflict with the Bill of Rights nor was the Bill of Rights meant to conflict against Copyright. That was why Fair Use Exemptions was invented under copyright law to be a balance between The Constitution’s copyright clause, copyright law, Freedom of Speech, and Freedom of the Press within the Bill of Rights under the U.S Constitution.

Twentieth Century Fox can come after anybody for exempting any portions of their copyrighted videos but if the uploader doesn’t have the money to fight for their Fair Use Exemptions under copyright law in a court of law then their Fair Use is being infringed and denied for simply being unable to afford a court battle. This is a dark day for Fair Use. If you can’t afford to fight for Fair Use then you don’t have the benefit of any rights guaranteed under law and should be denied due process, this is how the justice system treats poor people. Due Process was meant for both poor and rich. This is the corrupt Judaical sense of justice that we face.

Because I can’t afford to fight a court battle I guess I am considered a copyright felon as bad as those that upload whole movies. So much for my rights being protected because I don’t have the money to protect my rights. Fair Use isn’t for the disabled and poor people including the lower middle class.
