Serb Military Official Transfered to Portugal to Serve Sentence for War Crimes
A former Serb military official was transferred to Portugal to serve a 20-year sentence for crimes committed against non-Serb prisoners of war, the United Nations war crimes tribunal set up in the wake of the Balkan conflicts of the 1990s announced on 17 August.
On 27 September 2007, Mile Mrkšic, a former Colonel within the Yugoslav People’s Army (JNA), was sentenced by the International Criminal Tribunal for the former Yugoslavia (ICTY) to 20 years in prison “for aiding and abetting the murder, torture and cruel treatment of prisoners, as well as the inhumane conditions of detention at the hangar of Ovcara near the Croatian town of Vukovar between 20 and 21 November 1991.”
Severe Beatings, Torture, Murder…
Following the fall of Vukovar to JNA and Serb paramilitary forces, the JNA loaded about 260 non-Serbs from the Vukovar hospital onto buses and transported them first to JNA barracks and then to a pig farm at Ovcara, where they were subjected to severe beatings that lasted for hours, the UN reports.
During the trial, the ICTY found that later that evening, Mrkšic withdrew the JNA troops, leaving the prisoners to the mercy of paramilitaries who then killed and buried at least 194 of them in a mass grave at Ovcara.
JNA forces had established inhumane conditions of detention, and Mrkšic, who commanded the forces, failed to act effectively to ensure that the prisoners were properly protected.
Seventeen Countries to Enforce Tribunal Sentences
Portugal is one of 17 countries that have signed an agreement with the ICTY, which is based in The Hague in the Netherlands, to enforce the tribunal’s sentences. Mrkšic is the first convicted person to be transferred to Portugal.
In a news release, the ICTY commended the Portuguese authorities for their support in ensuring the enforcement of the Tribunal’s sentences, and called on Member States to assist it in securing additional enforcement capacity.
Since its inception 19 years ago, the Tribunal has indicted 161 persons for violations of humanitarian law committed on the territory of former Yugoslavia between 1991 and 2001. Proceedings against 126 persons have been concluded, and are currently ongoing for 35 accused individuals.
Convicted Officer Transferred to Denmark
On 11 November 2011, a former senior Bosnian Serb police officer convicted of war crimes and crimes against humanity by a United Nations tribunal was transferred to Denmark to serve the remainder of his 17-year prison sentence.
Ljubomir Borovcanin, the former deputy commander of the special police brigade of Bosnian Serb police forces during the Balkan conflicts of the 1990s, was found guilty last year by the International Criminal Tribunal for the former Yugoslavia (ICTY) of aiding and abetting extermination, murder, persecution and forcible transfer, the UN reported.
Crime Against Humanity
He was also found guilty, on the basis of command responsibility, of murder as a crime against humanity and as a violation of the laws and customs of war after he failed to punish subordinates who took part in the killing of prisoners.
The charges related mainly to his role during and after the “notorious massacres of Bosnian Muslims” in 1995 following the fall of the supposed safe havens of Srebrenica and Žepa.
The ICTY announced today that Mr. Borovcanin, 51, was transferred yesterday to Denmark to serve the remainder of his sentence, becoming the fourth person convicted by the tribunal to be transferred to that country.
Denmark is one of 17 countries that have signed an agreement with the ICTY, which is based in The Hague in the Netherlands, to enforce the tribunal’s sentences.
The Srebrenica Massacre
Drago Nikolic, the chief of security in the Zvornik Brigade, was found guilty of aiding and abetting genocide, extermination, murder and persecution and sentenced to 35 years in jail.
Abetting Genocide, Extermination, Murder, Persecution…

Radivoje Miletic, the chief of the administration for operations and training at the VRS main staff, was found guilty of murder, persecution and inhumane acts and sentenced to 19 years in prison.
Milan Gvero, the assistant commander for moral, legal and religious affairs of the VRS main staff, was convicted of persecution and inhumane acts and acquitted of the two counts of murder and that of deportation. He was sentenced to five years in jail.
Vinko Pandurevic, commander of the Zvornik Brigade, was found guilty of aiding and abetting murder, persecution and inhumane acts. He was acquitted of charges of genocide, extermination and deportation and will serve 13 years in prison.
Evidence from 315 Victims
The trial was the largest conducted to date at the ICTY, which is based in The Hague. Proceedings began in August 2006 and concluded in September last year. The trial took a total of 425 days during which the ICTY heard or otherwise admitted evidence from 315 witnesses.
The tribunal has indicted 21 people for crimes committed in Srebrenica. They include Radislav Krstic, the first individual to be convicted by the ICTY of aiding and abetting genocide in Srebrenica.
The appeals chamber sentenced him to 35 years’ imprisonment. The trials of Karadžic, Zdravko Tolimir, Jovica Stanišic and Franko Simatovic are ongoing. Ratko Mladic, the war-time VRS leader also charged with genocide in Srebrenica, remains at large.
Since its establishment, the ICTY has indicted more than 160 persons for serious violations of humanitarian law committed on the territory of the former Yugoslavia between 1991 and 2001. Proceedings against 123 have finished and proceedings are open for another 40 accused.
