Staat saboteert berechting Kalbfleisch/Westenberg

Begin dit jaar besloot het OM tot vervolging van oud-rechters Kalbfleisch en Westenberg omdat ze onder ede hadden gelogen over
1. hun vriendschap
2. hun contacten over de Chipsholzaak
Afgelopen vrijdag eiste de Officier van Justitie tot verbazing van vriend en vijand voor de eerste meineed slechts een taakstraf van 240 uur en voor de tweede zelfs vrijspraak. Een klap in het gezicht, niet alleen van Chipshol maar ook van de griffier mw. Van der Togt die de belangenverstrengeling van Kalbfleisch en Westenberg intern heeft gemeld. Steeds meer wordt duidelijk dat Justitie, OM en rechterlijke macht, niet alles op alles zetten om 2 corrupte rechters te veroordelen maar dat juist proberen te voorkomen.
NB. Om aan te tonen niet onder druk van hogerhand te staan, had het OM net zo moeten handelen als rechter Ingelse van het Hof Amsterdam, die Westenberg in 2009 veroordeelde voor liegen onder ede. Deze raadsheer weerlegde zodoende en afdoende onze veronderstelling in een advertentie dat hij beschermheer van Westenberg zou zijn.
Immers het OM besloot allereerst begin dit jaar Kalbfleisch en Westenberg alleen te vervolgen voor meineed en niet voor de strafbare belangenverstrengeling en samenspanning tegen Chipshol, waarvan de klokkenluidster de oud-rechters had beschuldigd. Naar aanleiding van dat vervolgingsbesluit schreef NRC niet voor niets op 4 februari 2012:
“Opvallend is dat de vervolging beperkt wordt tot meineed (…) De aangifte omvatte ook belangenverstrengeling (…) dat heeft het OM dus niet kunnen (willen!, JP) bewijzen. Of nog niet.”
Waarom het OM belangenverstrengeling niet heeft kunnen bewijzen is inmiddels duidelijk:
1. Naar Kalbfleisch werd geen FIOD-onderzoek gedaan.
2. Zijn Haagse vastgoedclubje werd niet onderzocht.
3. Essentiële Zwitserse taps zijn zwart gemaakt in het strafdossier omdat de Zwitsers te laat toestemming is gevraagd deze te mogen gebruiken, terwijl die juist nog een extra termijn hadden geboden….Lees verder
