First Sandy Hook Lawsuit Filed: $100 Million: Failure to Provide “Safe School Setting”

A lawsuit has been filed on behalf of a 6-year old student survivor of the Sandy Hook Elementary school shooting.

The suit, which is seeking $100 million in damages, alleges that the state of Connecticut and school district failed to provide a “safe school setting” and “an effective student safety emergency response plan and protocol.”

The unidentified client, referred to as Jill Doe, heard “cursing, screaming, and shooting” over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire, according to the claim filed by New Haven-based attorney Irv Pinsky.

“As a consequence, the … child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined,” the claim said.

Pinsky said he filed a claim on Thursday with state Claims Commissioner J. Paul Vance Jr., whose office must give permission before a lawsuit can be filed against the state.

“We all know its going to happen again,” Pinsky said on Friday. “Society has to take action.”

It’s not clear exactly what safety procedures the plaintiff is arguing should have been in place.

Numerous opinions suggest that security measures at the school were inadequate, which allowed gunman Adam Lanza direct access to school administration offices in the building, as well as classrooms.

Reports indicate that Lanza first entered the principal’s office, at which point principal Dawn Hochsprung turned on the school wide intercom system, likely in an attempt to alert teachers of the situation as it was unfolding. Hochsprung was killed in the attack.

Some teacher’s responded by immediately locking students into classrooms, while others may not have had time to react or were not sure what to do in response to the chaos unfolding live on the school alert system.

A debate has ensued in the aftermath of the shooting about whether the solution to preventing future attacks is to ban assault weapons like those that were supposedly used at Sandy Hook, or whether teachers and school administrators should be authorized to carry firearms on school property.

President Obama and some Congressional members who have weighed in on the conversation have said they will pursue weapons restrictions, but have made no mention of arming school officials.

The school attended by President Obama’s daughters has 11 armed guards, though some vocal anti-gun proponents are against such measures for public schools, claiming that Americans can’t afford to put a police officer in every school.

      arm the teachers is the only correct option any other you are fooling only yourself

      This is uncalled for. Arming all the teachers is not the answer. We cannot imprison our kids. Take the automatic guns off the streets, as many as we can. Lawsuits are not the answer. It is not the schools fault. People are getting stupid now.

        Ct has a semi-auto gun ban already. That doesnt work, and has been proven many times. If we cant trust teachers with a gun to protect our children. Then we cant trust them with our children at all. The only people that a gun ban is going to hurt is the law abiding citzen. A criminal doesnt follow the law. Do you really think a criminal is going to turn in a stolen gun. Nope I dont think so. Yea those children should get a settlement out of it, but it should be used for their psych treatment. Then what is left after that they should get when they are an adult. It is the schools fault, they should have better security. Yea people have been getting stupid, thinking a gun ban is what we need.

          I cannot agree more…making something illegal only knocks it into the deeper, even more unregulated and shady black markets. Law abiding citizens will be the ones disarmed….do people understand for every 100 people out there, about 80 or so are armed….do you know how many of those gun owners were capable of NOT killing someone today? Millions….not even kidding….millions of gun owners go day by day living perfectly normal lives without killing anyone with their guns….stop letting fear rule your world…this fluffy fairy tale world of peace and cupcakes will not exist if you disarm the American people.

          I am sorry its hard to accept that humans need to be responsible for themselves, you are blaming a hammer for putting a nail in the wrong place.

      Hell, the parents of that kid should be glad their child was not injured or killed. I’m sure the school & teachers took all the precautions they could. Souds like a B.S. scam to me. But hey for 100 million I’m sure they will all get over it just fine.

      I have worked at exposing insurance claim money laundering for the past 15 years. Although it is a huge operation, few outsiders are aware of the money laundering racket involving lawsuits and the liable insurance companies.       Seems a bit ironic the first lawsuit comes from the family of the surviving kid, this money should be going to the family’s that lost their children.

      The word “teachers” in this context is plural, not possessive. I see mistakes like this every day. Not only are our schools unsafe, they are not doing their job of educating our children.
