Utility Workers and Police Trespass to Install Smart Meter, Arrest Home Owner [Video]

Naperville, IL, resident Malia “Kim” Bendis and her neighbor were arrested on eavesdropping and resisting an officer charges after video recording two police officers and utility workers installing a “smart meter” – which have been linked to health issues – on her neighbor’s house.  The home owner, identified only as Laura, is clearly seen on video refusing consent for the utility workers and police to be on her property, along with expressing concerns for her child’s health and safety, but is threatened with arrest if she interferes.

What happened to 4th Amendment requirements? What happened to private property laws?

Why are the police masquerading as enforcing City Hall requirements when in reality, they are protecting a private company?

Illinois citizens are still being arrested for recording police officers despite a 7th Circuit Court of Appeals ruling last year that blocked the enforcement of the law on the grounds that it was unconstitutional.

The law, which made it a felony to record them, even while acting in their official role as a public servant – in public, where no expectation of privacy is considered – is highly illogical, especially in this particular case.  The police officers have marched on to private property and still expect privacy from the property owner?  What sort of bizarro world is this?  Oh, wait… it’s Illinois.

Let’s take this a step further for the nay-sayers; home owner is a willful customer of said utility company. Company attempts to change equipment; home owner refuses and protests. Business contract is now null and void between the two parties. Even if she had signed some sort of previous contract for upgrades, it can be voided and she has the right to end business relations with the utility company. She may face civil repercussions for violating certain provisions, but that does not involve the police – at all.

Here is another video when utility workers came to another house. The home owner demanded the workers leave her property but they refuse and start using bolt cutters to dismantle electrical boxes. While the equipment might belong to the utility company, a home owner has a right to demand anyone leave their property.  It is the responsibility of the utility company to then obtain a court order allowing access to the property to retrieve their equipment, if so inclined. Police arrested her for interfering.
