If Police Come To Your Door Without A Warrant, Shut Them Down Like This Guy (Video)

(N.Morgan) The one thing I cannot stress enough is to learn your rights as an American citizen. The 4th amendment is in place to protect us from this sort of tyrannical barging in of our homes and our personal lives. This is the way to handle unruly police officers trying to gain entry into your home. If police come to your door and you don’t need their help, you can simply decline to answer. They cannot come into your home without a search warrant. Even if the police have probable cause, they cannot come in your home without a search warrant. You might even be a suspect in a criminal investigation. In such a case you should remain silent — except to say “Officer, I can’t let you inside without a search warrant.” Following such an encounter, you should immediately contact a lawyer before speaking to police again.

 

 

 

 

 

 

 

The fact is that police can legally lie to try and gain access into your home and knowing how to deal with police at your door can go a long way. A video uploaded to facebook last week by Avel Amarel, shows Amarel doing a great job at shutting down the two officers who tried to gain access to his house. Notice that in the beginning of the video, police try to get Amarel to stop filming. Mission number 1, reduce accountability. Cheers to Amarel for standing his ground.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

      that when they get to your house they proclaim “probable cause” in order
      to get unlawfully into your house,
      Reject this line of BS.

      “Probable Cause” is for JUDGES to determine, not some
      ‘barely educated Cop is a Cop.

      Don’t let them in without a warrant SIGNED BY A JUDGE.

      I have advised people living in jurisdictions where cops have a reputation for abuse to install front and rear cameras with audio in their vehicles to record encounters to eliminate any burden of proof. I also advise when out walking and when that threat exists to wear a body camera that can record and upload to the internet. I am now advising people that when in their homes to have a camera at the entrances to their homes and businesses that can record encounters and an audio feature that enables you to communicate without opening the door. Opening the door escalates the encounter. While on audio, they can hear you call 911 and complain that officers are attempting to forcibly enter your home or place of business without a warrant and you are requesting to talk to the officer in charge or someone from the district attorney’s office via their dispatch to attest to the legality of the situation. It may go a long way in diffusing the situation post haste. Just some food for thought.

      building and not in your own home on your own property. Once you ‘step outside’ you
      are now on’public property’ and they will arrest you for ‘disorderly conduct’.

      The home owner asked the police SIX times for a warrant… and the police would not agree to get one… they wanted to do a “warrant-less search” which is against the law.

      A couple comments on the video (disclaimer: I am a Texas criminal lawyer, the following is not legal advice, there is no attorney – client relationship etc).

      1) I’m aware of no Supreme Court precedent that says the police must provide three forms of ID. There have been cases that have stated that state law can require and individual to identify themselves to the police if asked. Whether or not a statute like this exists varies state to state (for Texas, you do not have to provide a name if detained; if you do provide ID information it must be accurate. If you are arrested you must provide truthful ID).

      2) It is not illegal for the police to enter a home without a warrant, however there must be an “exigent circumstance” before this can take place. These are limited in scope. The police *can* pursue a fleeing felon into a home if they knew he went in there (i.e. they saw him do it) or if they hear him etc. None of these were the case here, therefore the individual here was well within his rights to keep the police outside.

      3) Someone mentioned earlier that asking you to step outside opens you to disorderly conduct. This is flat wrong. Disorderies can occur even on / in private homes.

      4) Related to 3 above, when confronted with police at the door of a home, I always advise people to step out on to their porch and close the door behind them. Note this video here: While officer #1 is talking to the resident, #2 is busy looking in the home to see what he can see. He’s looking for contraband / person in distress / etc so that they can enter the home.

      5) Related to 4 above: Stepping outside your front door does *not* mean you have entered the public. Surrounding residential properties is a space known as “curtilage”. Within this zone individuals have the same protections against search and seizure as they do within the home. You are still not considered “in public” here.

      6) Lastly, the filmer was protected because he was on his property filming. Had this encounter happened in a public space, he likely would have been arrested for failing to obey a “lawful” order. In situations like these it is best to either hand your camera to someone not engaged with the police or ensure someone else away from the confrontation is recording.

      I agree, the man did what was right according to law, I applaud him for it, but to say that ALL police or law enforcement officers are bad is just a bit radical. I personally know quite a few police officers, deputies and highway patrol officers and have the utmost respect for them. I do and will continue to trust them with my life. Yes, there are some bad apples in the bunch, that doesn’t mean ALL are bad. I try my best to uphold the law and respect the law and the people that enforce it. When you choose to not uphold the law don’t get mad at the police to enforce the law. They are doing a job that they are getting paid to do, just like every other man or woman in the world is doing, but they get paid very little for putting their lives on the line to protect and serve the people of the district in which they work. Do you go to work everyday knowing that today may be the day you get shot by some one who just robbed a bank, or who just went into a school and shot up the place? Unless you work in law enforcement or the military, chances are no. So you do not feel the stress or fear of knocking on a door to ask a question and someone shoots them point blank with a pistol, shotgun, rifle, etc…..or pulling over a person who is swerving all over the road, endangering the lives of everyone they meet and getting shot. Or responding to a disturbance call only to be met with a guy strung out on who knows what and tries to kill you. People are getting crazier and crazier as time goes by and we have no idea what they go through every day to not only protect themselves but to also protect you, someone they don’t know from Adam. So instead of always putting down law enforcement officers, you should be thanking them, because without you even knowing it, they might have saved your life today.

      Yeah, I know a lot of cops, all good guys. These cops were persistent, but they did leave and did the right thing, so, IMO, these cops aren’t bad either. Americans will learn their rights. It will become a necessity. I see more and more of incidents like this and it is encouraging.
