Emergency Use Authorization (EUA) to Enable Use of Needed Products in Civilian and Military Emergencies, United States
Issuance of an EUA is predicated on a Declaration of Emergency that justifies the authorization of the EUA by the secretary of HHS. The Act has no requirement that the emergency be the result of a deliberate attack with a CBRN agent to permit use of the EUA. For example, the secretary of HHS could find that an emerging infectious disease or pandemic (such as pandemic influenza) is so serious that it could rise to the level of affecting national security and thus declare a public health emergency under the terms of the Act.
