-Same-Sex Marriage Not legal in Colorado but Judge Rules They Can Go Ahead Anyway?

The whole re-definition of marriage to include same-sex couples began with judges in Massachusetts and in most cases continues to make gains through activist judicial decisions. Here is the latest case. A district judge in Colorado overthrew the laws of the state and granted permission to county clerks to issue marriage licenses to same-sex couples over the objections of the state authorities. Even though same-sex marriage has not been legalized in Colorado, a judge said today that a Boulder county clerk may continue issuing such licenses. …

Boulder County Clerk Hillary Hall took it upon herself to begin issuing licenses to same-sex couples on June 25; … Colorado Attorney General John Suthers filed a motion last week seeking to stop Hall from issuing the licenses.

In today’s order, Boulder District Judge Andrew Hartman said Hall must keep a record of the licenses. He also said she must let couples know that the validity of the licenses depends upon higher court rulings.

Response: This use to be a nation of laws where the people were supposed to be in  charge and their vote meant something. But when it comes to the issue of same-sex marriage, state laws and constitutional amendments voted in by the citizens and state legislatures no longer mean a thing in the face of judicial activism.

I have been happy with many of the SCOTUS rulings this year. However my greatest disappointment with the court was their refusal to take up and finally rule on the re-definition of marriage. Particularly their refusal to consider a federal appeals court ruling which struck down Utah’s constitutional marriage amendment and in the process disenfranchised the vast majority of state’s voters and officials.

Same-sex marriage in the USA does seem to be reaching the point of ‘fait accompli.’ It rather disconcerting how it all happened since most of the action was accomplished through the decisions of activist judges. Only a few states changed their marriage policies based upon an actual vote of the state legislature and none due to an actual vote of the citizens. In fact in most cases the vote of the people were overturned.            *Top
