-Judge Blocks Obama’s Transgender School Policy

Just in time for the new school year, a federal judge has blocked President Obama’s nation wide transgender school policy.  Here’s the story from  Christian Today:

Conservative campaigners have welcomed a US judge’s decision to block an Obama administration policy that public schools should allow transgender students to use the bathrooms of their choice.

The decision by Judge Reed O’Connor granted a nationwide injunction sought by 13 dissenting states just in time for the new school year.

While a setback for transgender advocates, the ruling is only the latest salvo in a larger legal and cultural battle over transgender rights that could be headed toward the US Supreme Court. …

O’Connor found the federal government failed to provide states with sufficient notice and opportunity for comment before issuing the guidelines. He also said the guidelines had the effect of law and contradicted existing legislative and regulatory texts.

Response:The Obama administration has over ridden local and state policies and laws with this executive order which has brought on lawsuits from 13 different states. Talk about over reach! However, this will probably go all the way through the federal court system. A new president could suspend this policy, but look for it to continue if Hillary Clinton is elected.

Notice the two points addressed by the judge:

1. Not enough time was given for adjustments to be made to the new policy.

2. The policy over ruled local and state regulations and legislation.

Time will overcome the first and federal judges have ruled against local laws and regulations in the past forcing changes.  So this may only be a short victory and reprieve until this case reaches the appellate courts.                 *Top
