JERRY BROWN'S THIRD TERM AS GOVERNOR ILLEGAL

Jerry Brown’s third term as Governor of California struck me as odd upon first hearing of it since no other previous person has held the office for three terms. There is a reason for jerry’s third term as Governor being odd, this being because he is not able, by law to do so.

Recently I find that since Jerry Brown served two consecutive terms in office as Governor of California from 1975 to 1983 he is, by California law not able to hold the office of Governor for a third time as per the California Constitution.

Article 5 Executive of the California Constitution states the following.

SEC. 2.  The Governor shall be elected every fourth year at the same

time and places as members of the Assembly and hold office from the

Monday after January 1 following the election until a successor

qualifies.  The Governor shall be an elector who has been a citizen

of the United States and a resident of this State for 5 years

immediately preceding the Governor’s election.  The Governor may not

hold other public office.  No Governor may serve more than 2 terms.

This Article of the California Constitution makes it clear that no Governor may serve more than two terms. It says nothing about waiting a few decades and being elected again or about consecutive terms. It is clear and understandable by all that once a Governor serves two terms he or she is not able to hold the office again, ever.

I suppose if Jerry’s current, term really was legitimate in terms of law Arnold Schwarzenegger could have run against him in this last election for his third term as Governor.

The same applies to the office of President. If the same mindset were applied to being elected to, the Oval Office for a third term Bill Clinton should have scrapped the laws of the American Constitution and gave it another shot. He did not because he knew he couldn’t under the law.

The same should apply in California regarding that state’s constitutional laws involving electing a Governor.

Under the Law Jerry Brown should be disqualified, removed from office and the state hold another election to replace him.

Only time will tell if the state of California upholds its Constitution or allows tyranny to prevail.
