Rafael Caro Quintero, former founder of the Guadalajara cartel, obtained an ex officio and plane suspension from a federal judge so as not to be extradited to the United States, a federal court requires it for the crimes of kidnapping and manslaughter of the DEA agent, Enrique Camarena, perpetrated in 1985.
In October, the First Chamber of the Supreme Court of Justice of the Nation (SCJN) refused to protect the kingpin against the Extradition Treaty signed between Mexico and the United States, Milenio reported.
The ministers left it up to the First Collegiate Court in Criminal Matters of the First Circuit to resolve only issues of legality to determine whether or not to approve the extradition.
The magistrates of the Collegiate had so far not resolved the case, because they have not yet received the judgment from the Court.
However, the capo was ahead of any adverse scenario and filed its demand for guarantees to prevent extradition.
The Fourth District Judge of Amparo in Criminal Matters, María Dolores Núñez Solorio, granted the suspension to the capo and prevented it in the sense that the precautionary measure will not take effect, in the event that the claimed act has been the subject of a different trial of protection.
Núñez Solorio said in his agreement that the drug trafficker requested the suspension with respect to the extradition order requested by the United States Government, but not the capture order he has in Mexico. He served 28 years of his 40 year sentence.
On August 9, 2013, Caro Quintero got his freedom after remaining 28 years in prison, because a collegiate court granted him an amparo.
The determination was fought by the former Attorney General’s Office and took the case to the Court where on November 6 of the same year the First Chamber revoked the sentence.
In December 2013, the attorney Jesús Murillo Karam, announced that Caro Quintero sent a letter to President Enrique Peña Nieto, in which he requested that he no longer be persecuted, because what he had to already serve.
In January 2015, the Second Unitary Court of the Third Circuit, based in Guadalajara, in compliance with the Court ruling again declared Rafael Caro and Ernesto Fonseca, Don Neto, criminally responsible for the crimes of illegal deprivation of liberty in the modality of kidnapping and qualified homicide, to the detriment of the DEA agent, Enrique Camarena Salazar and the Mexican pilot Alfredo Zavala Avelar.
Likewise, he determined that Caro had to serve the 12 years of prison that he lacked, so he was ordered to re-apprehend him.
The United States today offers a reward of 20 million dollars for the head of Caro Quintero. Since 1985, they seek to prosecute him for the murder of the DEA agent, a crime committed in Guadalajara, where Zavala Avelar was also killed.
