Missouri Bill Would Nullify NDAA “Indefinite Detention”
Representative Fitzpatrick, along with co-sponsors Representative Miller and Representative Curtman have introduced a bill to nullify the NDAA in Missouri. This bill was prefiled in December but currently has no scheduled hearing for this year.
House bill 57 reads, “Notwithstanding any contrary provision of law, no state agency, political subdivision, employee of such state agency or political subdivision acting in his or her official capacity, or member of the Missouri National Guard on official state duty, shall knowingly aid an agency of the armed forces of the United States in the detention of any citizen pursuant to 50 U.S.C. Section 1541 as provided by the National Defense Authorization Act for Fiscal Year 2012 or any subsequent provisions of law.”
50 U.S.C. Section 1541 applies to the War Powers Resolution which unconstitutionally handed over the responsibility of declaring war from Congress to the Executive Branch.
Missouri HB57 reaffirms an active role of the state Government established by the Constitution and says NO to the kidnapping of the people living there.
In 2012, Virginia became the first state to pass such a law, and more than 15 local governments around the country did the same. In 2013, sources close to the Tenth Amendment Center tell us to expect up to 12 or more states considering the same.
