Sentencing Victim Statement

Here’s the statement I gave at this morning’s sentencing hearing for our infamous stalker. My wife also gave a victim’s statement, which laid out the specific chronology of the attacks on my family and others. Then she read dozens of Frisch’s vile missives out loud from a number of platforms.

The text of my statement follows:

Good morning, your honor.

In the days leading up to this, the fourth sentencing hearing I’ve appeared at for Deborah Frisch, I gave a lot of thought to how to deliver this latest victim statement.

I thought about detailing the dozens of times Helen and I have driven the hour from Frederick to Greeley to attend these court proceedings.

— About the time and treasure we’ve spent pursuing justice for being victimized over the past 14 years, and the time it has taken from our normal lives, or the toll it has taken on our health and welfare, as well as the health and welfare of our children.

— About my wife’s anguish each time we’re asked to deliver a victim statement, which compels us to revisit and comb through — again and again and again — the thousands of Tweets, and emails, and internet postings from Deb Frisch attacking us, our children, our family, and our place in our community, in order, yet again, to present those postings to the court.

I’ve watched my wife lose sleep, and dread the process, because each time, she must relive the vile and evil things that have been posted and publicized to the world, about not only us, but about our children, neither of whom have ever interacted with Deborah Frisch in any way.

I thought about how to put into words the extent of our torment — and the lengths to which we have gone, since 2006, to end that torment, using a number of courts and a number of prosecutions to see that we get the relief from Deborah Frisch’s relentless attacks on us that we, as victims in all these cases, that we deserve.

In the end, I decided that the best way to articulate our ongoing grievances was to simply quote from my previous victim statements, and then to add a few additional thoughts, which I think will make clear the pattern of what my family has been through.

This first excerpt I’ll read is from our first sentencing hearing in Greeley, delivered to the court in Weld County.

“Firstly, let me note that, thankfully, we are not here today to decide on the guilt or innocence of Ms Frisch. She has plead guilty to a felony — and she’s done so for the sole purpose of gaining release from incarceration. This is evident, I submit, in both the tenor and substance of her own statements. She continues to refer to my family — and by extension the families of all those she’s harassed and sough to libel and intimidate over the past 11 years — RECALL, this was written now 3 years ago — as “so called victims,” while simultaneously casting herself as the REAL victim of some grand conspiracy in which law enforcement, the judiciary, court personnel (including her own council), and an expansive collection of private citizens, are all responsible somehow for her decade-plus-long social and legal travails.

“Such fantasies of persecution, coupled with the kind of malignant narcissism that, in her mind, justifies her behavior toward her victims, to me seems indicative of an unrepentant mind. More so, her latest incarnation as a self-proclaimed justice advocate — whose role it is to unmask what she claims to be some endemic iniquity in the legal system, using herself as the crowning example of such serial iniquities — reinforces my belief that she’ll use her own warped sense of persecution to justify continued assaults on those she contends have aggrieved her.

“Not every one of her victims has taken the time nor expended the effort to prevent her from continuing her criminal behaviors, Many, in fact, have thought — incorrectly, as it turns out — that if they ignore her she will simply grow bored with them and leave them alone. Her multiple arrests, however, speak to the reality of who she is, and to the futility of such an approach: Miss Frisch will NOT, and has NEVER, ceased her pattern of stalking, harassment and intimidation, save for those times when she is physically prevented from doing so thru incarceration.

“If we can’t find relief from the Court, we wonder just where and how we WILL be able to find relief. And perhaps more crucially, we worry that our own children will lose faith in a system that either can’t or won’t protect them.

“Please allow me to say this: My wife and I do not believe for a MOMENT that Ms Frisch will EVER stop what to her has become both a way of life and now, apparently, a righteous cause, in which we play the perpetual nemeses to her crusading heroine of “justice advocate.” Ms Frisch’s unwarranted sense if her own superiority and rectitude.. practically compels her to harass to terrorize, to threaten, to intimidate, to libel, and to extort.

“We have no confidence that Ms Frisch’s return to living with her parents will do ANYTHING, save provide her the means and opportunity to once again find a way to game the system and harass her victims. She has shown she will use aliases, or misrepresent herself, to continue doing the things she does which have come to define her and, in a twisted way, provide her with a sense of worth in the wake of a career devastated by her own actions,

“We ask the court to please consider the lack of other recourse her victims have when it imposes her sentence.”

That was excerpted from my 2017 victim statement.

Here are excerpts from my 2018 victim statement,

“As I first did a year and a half ago at the initial sentencing hearing, I’ll note yet again that we are not here today to decide on the guilt or innocence of Ms Frisch. She has plead guilty to a felony — and that plea comes in exchange for having OTHER felony charges dropped, and the felonies she committed to secure those charges forgotten. Legally. But that nicety doesn’t change THE FACT of those crimes having been committed, nor my family’s position as victims of those crimes.

“Please allow me to say this — a reprise of what I first noted to the court over a year ago: My wife and I do not believe for A MOMENT that Ms Frisch will EVER stop what to her has become a way of life. Her unwarranted sense of her own superiority and rectitude…practically compels her to harass, to terrorize, to threaten, to intimidate, to libel, and to extort. These are the behaviors that define her. And while we have sympathy for those who suffer from mental illness, I will point out that most people who suffer from, for instance, bipolarity, don’t fetishize mass shootings and child murders, nor do they engage in the constant and repulsive sexualizing of children — with the further need to publish and amplify those fancies.

“At some point, if her victims are to get any sustained relief, Ms Frisch needs to be treated as an adult with free will, and punished for what she freely and joyously does to harm others. And as other courses of action — from mental health treatment to extended probation — have failed to alter her disposition, we feel that she needs to be put in prison.”

That statement was dated April of 2017.

In each of these victim statements — with all due respect to the court, who has sought repeatedly to give Ms Frisch the benefit of the doubt and worked toward her rehabilitation, through either a family “support group” or through probation and mental health treatment — I believe we have proven prescient.

And this is not because we have any specialization in psychology or psychiatry, but rather because we have been dealing with Ms Frisch and her manipulation of the court system since 2006.

Ms Frisch, as she routinely does at every time of sentencing, will apologize and appeal to the court for mercy and treatment. She’ll likely argue that she needs the very same “support system” that has repeatedly not only helped her, but has enabled her behavior.

Ms Frisch’s family has known, since 2006, when she was featured on a national news report for her threats against my then 2-year-old son, that she is given to these kinds of repetitive behaviors.

They have been contacted, and made directly aware of the kind of pornographic filth she was posting about minors.

In the course of 14 years — where today we’ll be told about her mental health issues — they have NOT ONCE reached out to any of the victims to express their concern, nor to offer condolences. Instead, they’ve sheltered Ms Frisch and funded counsel and appeals and otherwise supported her.

They’ve appeared in court to argue that, should she be relegated to their custody and oversight, she’d be looked after, given the treatment they routinely — at every sentencing hearing — claim she needs, only to soon after allow her to return to her ways.

They — like Ms Frisch — have bet on the Court allowing her to return to CA; there, she feels safe from Colorado law.

Here is the bottom line, judge, and I beg your indulgence:

Ms Frisch has tormented my family now for a full 1/3 of my wife’s life, and nearly a quarter of my own. She has gone after my oldest son repeatedly and in the most vulgar and pornographic ways for a full 90% of his life.

And now, since her last reprieve through probation, she’s begun focusing on our youngest son, who is 8.

My wife and I have been married for 20 years. Through 70% of our marriage, Frisch has thrust herself into our lives.

WE are the victims, and yet time after time, the court has decided — out of an understandable sense of worry and compassion — to provide Ms Frisch with a reprieve, a chance to get her life together, to get the mental health she— at every sentencing hearing— suddenly claims she needs.

But the fact is, it’s been 14 years. Ms Frisch comes from a wealthy family, and she is supported by an Oregon pension and disability allotments from the government. She has not used that time and money to seek help for whatever illness she’ll now claim she suffers from.

Well, we’ve had enough. We’ve agreed to every one of her plea agreements, hoping she’ll get help — but knowing all the time that she would not, could not, and so would resume her tortures of our family.

And so we can say, I believe, with 14 years worth of certainty, that the way to deal with Ms Frisch is simple: it is to incarcerate her, and to provide justice and relief to her victims.

I love Colorado, but I don’t believe for a second that its geographical boundaries or mountain air can somehow magically cure her mental illness. And yet, when she is here, or in DOC, she shows no signs of that illness. Suddenly, amazingly, her impulse control is kept in check. A GPS monitor has proven to be the most effective drug against her recidivism. And that should tell you all you need to know.

We agreed to an 11-year probation. When Ms Frisch accepted that agreement, it was clear that violating the terms of her probation meant an AUTOMATIC prison sentence.

She will throw herself on the mercy of the court, and her family members will once again deliver assurances that they can comfort, care for, and control her.

Rubbish.

It’s time that we, the victims, are shown mercy. And the only way that can happen is if Ms Frisch is given the prison time she has spent the last decade and a half earning, and earning with honors.
