Tesla receives another Model S P85D lawsuit in Norway

The Model S P85D has become quite a controversial vehicle in Norway, especially after more than a hundred Tesla owners managed to win a lawsuit against the California-based firm last year over alleged false advertising of the high-performance electric car. Now, a new batch of Tesla-owning plaintiffs has emerged in the country, and they are hoping to reach the same settlement as their predecessors.

The new lawsuit outlines the same complaints as the 2017 case, with the 79 new plaintiffs claiming that Tesla misrepresented the Model S P85D when the company marketed its performance numbers. The Model S P85D, the first of Tesla’s cars to offer a dual-motor configuration, was promoted by the Elon Musk-led electric car firm as a vehicle with 691 hp. When Tesla enthusiasts ran the car on the dyno, however, many were disappointed to discover that the P85D only had 469 hp.

The reason for the discrepancy was rather simple. Being a dual-motor vehicle, Tesla advertised the Model S P85D with the combined horsepower from both its front and rear motors. The front motor of the car produces 221 hp and the rear, as could be seen in dyno tests of the vehicle, produces 471 hp. Combined, the P85D’s dual motors do align with Tesla’s figures, producing a combined 691 hp. For some P85D owners in Norway, however, this was tantamount false advertising.

Christoffer Falkeid, the lawyer representing the 79 new Model S P85D owners, stated that his clients are looking to get the same settlement as their predecessors from last year. When Norway’s courts ruled in favor of the plaintiffs last year, Tesla ended up paying 65,000 kroner (about $10,500) to each plaintiff to settle the case. Others opted to receive a combination of cash, upgrades to their vehicles and additional equipment packages.

“It’s the same kind of case that ended up in a compromise the last time. It’s about the power of the car and the mistakes in marketing and in the sales process, but I do not want to go into amounts,” the lawyer said, according to a Dagens Naerlingsliv report.

Despite its legal troubles with some disgruntled Model S P85D owners, Tesla remains thoroughly committed to its ever-growing customer base in Norway. The European nation, after all, is one of the most progressive countries in the region when it comes to clean and sustainable transportation. Tesla CEO Elon Musk, for one, has personally praised Norway for its pledge to ban the sale of ICE vehicles by 2025. The Model S has also held the title of best-selling vehicle in the country, besting other EVs and ICE cars alike.

As we recently reported, several high-profile Norwegian firms such as ASKO and Posten Norge have fully embraced the Musk’s vision of the future, with both companies filing orders for the Tesla Semi, which is expected to be rolled out in 2019.
