[Watch] Cop Pushes Wheelchair-Bound Invalid Onto Ground For Running Over His Foot

A man with a broken neck and back was pushed to the ground by a Lafayette, Indiana; police officer after the man is seen driving over his foot. The man, 25-year-old Nicholas Kincade can be heard afterwards telling the officer his medical conditions, to which the officer responds, “I don’t care.”

The officer, Tom Davidson, appears to partially block the path of Kincade, almost daring him to drive over him, which is what happened.

The incident occurred on October 1st of last year, with the dashcam video just now being released to the public.

After pushing Kincade to the ground and telling him “Now you’re going to jail,” Davidson can be heard chastising the invalid for not exercising better control of his motorized wheelchair.

Officer Davidson tells Kincade, “I told you to turn around and go the other way.”

Kincade claims he didn’t see Davidson, which is clearly impossible to believe. It is also impossible to justify the taunting and actions of the officer. This is not an appropriate or measured response. The Chief and review process, surprisingly, agrees.

Police had responded to a call to the Excel Center in Lafayette, IN, after someone told the school security Kincade was in possession of a gun. That turned out to not be the case, but because he was in possession of a pocket knife, although it is difficult to understand how he, an invalid would use it, he’s treated as a threat. Kincade was given a trespass warning and told to leave. It was then that the confrontation with Officer Davidson occurred and Kincade was subsequently assaulted and arrested.

The Police Chief, Patrick Flannelly agreed that the whole escalation was unnecessary, stating “It’s clear to us that the whole use of force in this case could have been avoided just by different positioning, by offset positioning, by moving out of the way, by not standing where he was standing.”

There is a four second period between the time Kincade starts to move and the contact with Davidson’s foot. That should have been plenty of time for the officer to move himself out of the way, but that wouldn’t have demonstrated his power over the invalid.

Voicing his disapproval for the officer’s actions, Chief Flannelly said, “Police officers cannot put themselves in a position where the subsequent need to use force is created. We can’t do that.”

Chief Flannelly reported that upon an internal review of the incident, he and six other members of the command staff unanimously felt Davidson used both conduct unbecoming an officer and an excessive use of force and recommended termination.

An appeal of their decision determined that the use of force was not excessive. Davidson was demoted to officer and suspended without pay for thirty days. He has since returned to work.

This rationale and objective review and action on the part of the Lafayette Police Department is becoming increasingly uncommon among the militarized police across America.

Chief Flannery should be applauded for recognizing that one of his officers acted improperly and taking appropriate disciplinary action.

      The offizier probably thought he was being very gentle by not shooting the old fart 10 or 20 times. After all, an electric wheelchair weighs many times as much as a bullet, or 10 or 20 of them.
