A few days ago former federal prosecutor Andrew McCarthy penned a blistering piece at National Review Online accusing Obama of massive fraud for repeatedly lying about Obamacare. Last night McCarthy appeared on Fox News‘ The Kelly Files to take his argument to the masses:

The Justice Department is notoriously aggressive when it comes to material omissions by public corporations. Any public statement — not just in a required SEC filing but in any public context — may be deemed actionable if its purpose is to deceive the general public about a company’s condition. For example, as I’ve noted before, the Justice Department indicted Martha Stewart for fraud over press statements that did not disclose damaging information about her company.
Ms. Stewart, naturally, was fearful that truthful statements would send the stock price plummeting. Obama, by comparison, was not lying merely to prevent a company from losing value. His fraud was, first, to induce passage of a plan designed gradually to destroy the private health-insurance market — a plan that barely passed and never would have been enacted if he’d been honest. And later, his fraud was to procure his reelection and the guaranteed implementation of Obamacare; had he been honest, he would have been defeated and Obamacare forestalled.
Barack Obama is guilty of fraud — serial fraud — that is orders of magnitude more serious than frauds the Justice Department routinely prosecutes, and that courts punish harshly. The victims will be out billions of dollars, quite apart from other anxiety and disruption that will befall them.
The president will not be prosecuted, of course, but that is immaterial. As discussed here before, the remedy for profound presidential corruption is political, not legal. It is impeachment and removal. “High crimes and misdemeanors” — the Constitution’s predicate for impeachment — need not be indictable offenses under the criminal code. “They relate chiefly,” Hamilton explained in Federalist No. 65, “to injuries done immediately to the society itself.” They involve scandalous breaches of the public trust by officials in whom solemn fiduciary duties are reposed — like a president who looks Americans in the eye and declares, repeatedly, that they can keep their health insurance plans . . . even as he studiously orchestrates the regulatory termination of those plans; even as he shifts blame to the insurance companies for his malfeasance — just as he shifted blame to a hapless video producer for his shocking dereliction of duty during the Benghazi massacre. The SENATE took a bill from the house, and UNCONSTITUTIONALLY gutted it and replaced the entire contents of the bill with ACA/Obamacare! I say UNCONSTITUTIONALLY because obamacare is nothing but a GIANT TAX! and the Constitution for the united states of America

All Bills for raising Revenue shall ORIGINATE in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.
The senate did not propose or concur on a bill raising revenue from CONGRESS but ILLEGALLY GUTTED A CONGRESSIONAL BILL AND REPLACED ITS CONTENTS WITH A REVENUE BILL!
THATS CALLED FRAUD!!!

Stop lessening to these Commies, It has nothing to do with the role out! It’s this thing they’re calling a law. It is unconstitutional as hell and I knew our government had sold us out (both the Democrats and the establishment Republicans) but our supreme court as well? How did these Commies pull that off is beyond me but I bet it has something to do with the NSA and something they dug up on the justices that serve on the Supreme Court. It is obvious to even a 3rd grader that this “law” is so unconstitutional that it’s sick. I don’t care which side of the isle you stand on, if you just stop and think about this, there is only one conclusion you can come to. It’s unconstitutional as hell. How can anyone force you to buy something that you do not want and then if you don’t, they punish you by forcing you to pay a fine. Calling it a Tax does not change the fact that it is a form of punishment for those that do not do what the government wants them to do. It would be no deferent if one day they said that they’re tired of all these illegal immigrants driving with no insurance and getting into accidents. So instead of kicking them out of the country, they just say “we got a new law” it’s called the ACA (Affordable Car Act). Now everyone in this country will pay the government $300 a month from the age of 16 to death and every one will now be covered from those that don’t have insurance and if you don’t pay us then we are going to take it out of your bank account , send IRS agents to your house to harass you and/or put a lean on anything you own. But wait, you don’t have a car. Hell you don’t even have a bike. Let’s say you walk to work or take a cab or buss. But because you are 16 or over, one day you may for some reason find yourself behind the wheel of a car and there for will need car insurance, Hence “THE LAW”. Do you see how crazy this is? do you see how un constitutional this is? But, But, But it will help the majority of people you say. Since when does that make it right to trample on the rights of others, even the one? O, it’s all good until you are the one who is getting the shaft. This government was never mint to take care of the majority at the expense of others. That is Communism/Socialism. That is the role of the people and it’s communities. This Government is hear for the sole purpose of protecting the rights of the individual, so the majority cannot romp over you or anyone else’s God given rights. “it’s for the greater good”, that BS line has been used by every two-bit wood be dictator from the beginning of time, worldwide and to present day. That is why we (our four fathers) established this nation the way they did. In order to insure that this would never happen again (at lease hear). That is such the wrong mind set and this government has exceeded its mandate and needs to be overhauled ASAP. We are selling our Nation and its people out for a pipe dream that time after time has never worked anywhere in the world. What makes you think we will be the ones that get it right? God the hubris of our nation is staggering. Now yes, there needs to be an answer to health care in this country but this is not it nor should we be looking to government for the answer either as this Government has gone from by the people for the people to by the government for the government and damn the people. For the government’s part, it’s all about controlling us and they could care less about our health. When this started can be debated but fact is this is where we are today. Answers to this important question need to come from us and our community with great care not to invade on the rights of the individual as the individual is where our strength comes from and harm to ones rights is harm to us all. I hope I have made since to you and if you are a supporter of the ACA, I hope I have shown you why this is so wrong and needs to be stopped. Fact is that that I think I have an answer that would provide free health care for all Americans, that’s right FREE but it would require the government to give the power back to its people and it would require the people to take a much more active role in government but I fear that our government will never give the power back to the people without a fight. Therefore, until we take our country back from these criminally insane control freaks, my idea will never work. It would also require that we take the rights of a citizen away from the corporations as well and that is a another fight as they will not want to give that up either (this should never have been given to corps to start with).With all this said, My family and I will not take part in O’Commie-care in any way what so ever and I will do everything in my power to insure that I do not pay the fines. I will not be part of anything that strips the rights away from my fellow Americans and flies in the face of our constitution. I’m only one man and I may lose but I will go down fighting for my family and yours. I will not sell you out for a hand full of beads, my American brothers and sisters. To those of you that would say that I’m not doing this for you, I say yes I am and I’m sorry you do not see it that way but I hope that one day you and your children will. To those that understand what I’ve just said and agree with me, please help me in my fight by not ever giving up and fighting back at every turn. Know that we may lose but it is a far better life to go down fighting than to live a life as a slave to this or any other government. I had rather die than sell out my countrymen and our constitution. O and the day this is no longer a law I will go on line and check it out to see how much it will cost my family as we would love to get some insurance but as long as they are going to ram this unconstitutional law down our necks, I will have no part in it (even if it cost $1 a month as that is NOT THE POINT). Please remember that it’s not about right or left, it’s about right and wrong (live free or die a slave). May God bless you all and I thank you for taking the time to hear me out.
