According to a new report by Fox News, the decision at the FBI to not prosecute Hillary Clinton was made at the top levels of the FBI and Department of Justice, overruling the almost unanimous recommendation of the agent’s and attorneys who wanted Hillary Clinton charged.
The source who worked on the investigation and spoke to FoxNews.com on the condition of anonymity, said FBI Director Comey’s announcement that he would not recommend to the Attorney General’s office that Hillary be charged dismayed and disgusted the investigation team of more than 100 FBI agents, analysts, and DOJ attorneys.
“No trial level attorney agreed, no agent working the case agreed, with the decision not to prosecute — it was a top-down decision,” said the source, whose identity and role in the case has been verified by FoxNews.com.
A high-ranking FBI official told Fox News that while it might not have been a unanimous decision, “It was unanimous that we all wanted her [Clinton’s] security clearance yanked.”
“It is safe to say the vast majority felt she should be prosecuted,” the senior FBI official told Fox News. “We were floored while listening to the FBI briefing because Comey laid it all out, and then said ‘but we are doing nothing,’ which made no sense to us.”
Judge Napolitano heard a similar story from his FBI sources:
“It is well known that the FBI agents on the ground, the human beings who did the investigative work, had built an extremely strong case against Hillary Clinton and were furious when the case did not move forward,” said Napolitano. “They believe the decision not to prosecute came from The White House.”
According to the source the worst part of Comey’s announcement was he laid out the strong case and basically said he isn’t recommending that Hillary be charged, because if he did the DOJ would not follow the recommendation. That’s not the role of an independent FBI “the bureau’s role was merely to advise, Fox News was told.”
“Basically, James Comey hijacked the DOJ’s role by saying ‘no reasonable prosecutor would bring this case,’” the Fox News source said. “The FBI does not decide who to prosecute and when, that is the sole province of a prosecutor — that never happens.
“I know zero prosecutors in the DOJ’s National Security Division who would not have taken the case to a grand jury,” the source added. “One was never even convened.”
Fox’s Judge Napolitano agreed, saying the investigation “was hampered from the beginning, because there was no grand jury, and no search warrants or subpoenas issued.”
Last week while testifying before congress, FBI Director Comey said, “This case was investigated by a group of professionals so if I blew it they blew it too,”
Though the political decision of the FBI director and the Attorney General to let Hillary Clinton off the hook, the reputation of the FBI has taken a hit, the morale of the Department has probably taken a similar hit, and even worse Comey has lied to Congress while throwing the agents who wanted Hillary prosecuted, under the bus.
