Comey Won't Accuse Trump of Obstruction of Justice: “He Is Not Going to Congress to..."

Former FBI Director James Comey reportedly does not plan to testify on Thursday that President Donald Trump sought to interfere with the investigation into former national security adviser Michael Flynn.

At a meeting in February, Trump allegedly said he hoped Comey would end the investigation in Flynn.

“I hope you can see your way clear to letting this go, to letting Flynn go,” Trump said, according to the New York Times. “He is a good guy. I hope you can let this go.”

The Times did not obtain a copy of the memo, but based its reporting on what a source stated the document contained.

While Trump’s request made Comey uncomfortable, he will not accuse the president of obstruction of justice, a source told ABC News.

“He is not going to Congress to make accusations about the President’s intent, instead he’s there to share his concerns,” the source said, and tell the committee “what made him uneasy” and why he felt a need to write the memo documenting the conversation.

Legal experts on both the left and right have noted that even if everything allegedly contained in the Comey memo is true, it would likely not amount to obstruction of justice.

Trump “left the matter to Comey’s discretion, with the hope, but not the insistence, that…discretion be exercised in Flynn’s favor,” former federal prosecutor and National Review columnist Andrew McCarthy writes.

Acting FBI Director Andrew McCabe testified last month before the Senate Intelligence Committee that there have been no efforts by the Trump White House to obstruct the agency’s Russia investigation, which would include Flynn.

Though Comey reportedly does not plan to testify Trump tried to obstruct justice, he does plan to dispute the president’s claim that he told him he was not the subject of an FBI investigation.

In his letter to Comey informing of his decision to fire him, Trump wrote, “While I greatly appreciate you informing me, on three separate occasions, that I am not under investigation, I nevertheless concur with the judgment of the Department of Justice that you are not able to effectively lead the Bureau.”
