It All Started With a Garage Sale!

One of our members just found this desperate plea for help posted on the Freecycle Group, for circulation among all subscribers:

Hi there
Believe it or not, Brevard County Permitting and Enforcement says we have to vacate our property by June 18 because of a code, even though we paid our taxes and are still a paying a mortgage on a house that we lost from the Hurricanes of 2004. And yes, we have submitted the story to all the news stations and newspapers ;)

We need moving boxes of all shapes and sizes since Brevard County is making our family homeless.

It was just pointed out to us that Brevard County can use force to make us leave AND put a lock on our stuff and keep it. I even asked the agent what was going to happen to our children?
 
I have had Action 9 and Channel 13 respond so far.
 
And would you believe all of this started over a garage sale we had the end of March (first one in almost 10 years since we have lived here) and since our neighbor owns the driveway land even though per our deed we have legal use to of it, she called Code Enforcement on us.
 
Feel free to spread the story. I may do up a website with all the info.

Nikki Lally has just contacted us! 

Here is her complete story, in her own words:

“Please help and feel free to tell our story. We have lived on State Road 520 (also known as King Street, West King Street and Highway 520) for almost 10 years. We had a garage sale back toward the end of March 2009 (first one in almost 10 years) and since our neighbor owns the land the driveway is on (per our deed, we have legal use of it), she didn’t like all the traffic and called Code Enforcement.

Since then, we have down everything that Code has asked us to do including letting them come out and take pictures inside of our studio apt/garage.

We lost our house from the 2004 Hurricanes and Hurricane Wilma in 2005 put us underwater as well as Tropical Storm Fay. The house was torn down in 2006 after it took 13 adjusters and 2 engineering company reports before State Farm would recognize the damage as hurricane damage. We only had a insurance trailer for 7 months and then we moved into the studio apartment above our garage. We bought it like this almost 10 years ago.

Apparently, code says you cannot have a garage without a house even though our garage is a 2 story detached garage. Per Code’s recommendations, we even submitted a building permit application to get our studio apartment/garage zoned into a house.

We got scammed out of our insurance money

and our mortgage company is sitting on the rest. Apparently, Chase says if we had repaired then we could have access to our money but since we are rebuilding, we have to go out of pocket first and then after Chase inspects it then Chase will reimburse us our money.

We just got the letter from Permitting and Enforcement on this past Saturday telling us what fixes we need to bring our studio apt to code for a house and then code comes out on Tuesday serving us with notice that we have to vacate our property by June 18th. I even asked if we could pitch a tent ON OUR PROPERTY and the agent said ‘NO, you will be fined.”

I find it totally unbelievable that words on a paper can make our family homeless even though we have paid our property taxes, paying a mortgage on a house that does not exist and have never lost our homestead exemption.

I told the agent that I may be shooting myself in the foot but we are not leaving as we have neither the money (I got laid off in Feb & hubby in March – he just got job down in Miami so he lives down there during week.) nor anywhere else to go.

Any assistance would be greatly appreciated. Action 9 & Channel 13 have responded to our story.

so that they can keep that home!

Thanks so much for contacting me…I can honestly assure that we have not lied to you and we are telling you the WHOLE story. I do have to tell you that after I hung up with you, I must have bawled for hours. We are having complete strangers make accusations against us and that really just about did me in. I felt so alone. I still feel so alone. What did we ever possibly do to deserve this????…
It used to be a big joke about the different paths the hurricanes took but they always crossed over the Lally house :)
 
 
I found the original notice that John Fecteau had left on our fence. It mentions ‘continuous yard sales‘. Heaven help them if they are using FreeCycling against me…I have attached the copy for you.
We are honest people. I am so upset that we are being accused.

In desperation, Nikki decides to send an e-mail to a former co-worker. She is worried (needlessly–we totally believed her, because we have all been through the lies, and attempts to discredit us, that she is now going through) that Florida F.A.C.E.OFF. will not believe her story, and she wants someone who knows her, and who knew the details of her case, to be aware of her plight. These are her words from that e-mail:

Not sure if you remember me but this is Nikki Lally. I do not know if you will remember some of the stories that I used to tell at the birthday luncheons about all of our troubles from the hurricanes (2004 Hurricanes and Hurricane Wilma in 2005) and then all of our trouble with State Farm (took 13 adjusters and 2 engineering company reports) paying us our insurance money. I do not know if you will recall how we got scammed out of our insurance money to rebuild and after the insurance trailer was taken away, how we moved into the studio apartment above our garage when our house was torn down after it split into 6 large pieces.

All of our recent trouble started with a garage sale the weekend of 3/21 and 3/22. Our neighbor owns the land the driveway is on but per our deed, we have legal use of it and it is our access to State Road 520. Our neighbors threw a hissy fit because of all the traffic even though it was the first garage sale we have had here in almost 10 years. In fact, the son even stopped in the driveway and yelled at my wonderful husband about all the traffic and all the junk in the yard. They called Code Enforcement about the garage sale and even stated I was having a continuous garage sale which is my FreeCycling where I give stuff away for free and people come and pick it up. Code Enforcement then gave it to Building who said that according to code we cannot have a garage without a house. Per their recommendations, we even let them inside and they took pictures (yeah, we are still too trusting) and we submitted a building permit so we could get our studio apt. on second floor/garage (it was like that when we bought property almost 10 years ago) rezoned/recoded as our house then get a variance when we rebuild. We got letter regarding our permit on Saturday 5/16 and on 5/19, Permitting and Code came out and served us with violation stating that we have to vacate where we live by 6/18 because “This structure is declared to be a public nuisance and a threat to the health, safety and welfare of the citizens of the neighborhood and the building official or designee has prohibited its or occupancy.” We have survived so much and endured so much more and am paying a mortgage on a house that does not exist, have paid our property taxes and have NEVER lost our Homestead Exemption and because of a CODE, they are making us and our 3 teenage boys HOMELESS!!!! I even asked about pitching a tent to stay on OUR property and the agent Thomas Sullivan told me we would be fined. How can Brevard County make us move out of our home???? And to pay a mortgage on property and NOT ALLOWED to live there. The agent tried to tell me he understood. NO WAY ! I asked him if he had lost his house to the hurricanes, if he had EVER been flooded and under water then I told him not to say he understood. I told him the whole office HAS NO EMPATHY! 

…our story has been picked up by Florida F.A.C.E.OFF. They have been trying to get a meeting with our District 1 Commissioner Robin Fisher. I found out today that during a commissioner/council meeting…another member of FACEOFF got up and started to talk about the Lally situation…

I already told Thomas Sullivan that I may be shooting myself in the foot but we were not leaving our property. I refuse to allow a code to make our family homeless even though we have paid our taxed, have never lost homestead exemption and are still paying a mortgage on a house that no longer exists. After I got laid off in Feb, Rich got laid off in March. He finally found a job…So, it is just me doing all the phone calling and meeting people who are coming out to our house and so forth.

It is still so amazing that all of ‘this’ started with a garage sale back in March…this turned into 2 cases. When our neighbor called to complain about the yard sale (first one in almost 10 years) and ‘continuous yard selling’, the agent John Fecteau said that there is a code that says you cannot have a garage on your property without a house. So he forwarded the info to Permitting and Enforcement.

Originally code enforcement also cited us for having farm animals, litter/junk in yard, failure to maintain, junk vehicles (talking about our 69 Lincoln and we let some friends store their Ram Charger while they moved out of state) and having a commercial vehicle…They want me to give up my baby, Snowflake, my pygmy Nubian. It just about breaks my heart since I bottle feed her and have had her since she was a baby. And we are only allowed to have one chicken!!! They are taking food out of our children’s mouths…

And we even brought all the proof to Viera to show Mike? that the State of Florida says the box truck is NOT a commercial vehicle, the Brevard County Tax Collector says it is NOT a commercial vehicle and our insurance company says it is NOT a commercial vehicle. But when we brought this info to Code Enforcement including the request from the Brevard County Tax Collector to call them, all we got from Mike ? was “There’s more to it than that.”

I had no idea that Brevard County Code Enforcement has more power than the State of Florida.

 

We did find out that the continuous yard selling is actually our FreeCycling where we post FREE stuff on Yahoo groups and people come and pick it up. I cannot believe that I am being accused of selling when we try to help others in Brevard County by giving them stuff that they need. Mothers who cannot afford to buy clothes for their sons. Women who need clothes for work. Parents who have been laid off and and have lost so much who need sheets for their kids to sleep on.

 

I have also been trying to contact my District 1 Commissioner Robin Fisher to make an appointment to meet with him in person. I voted for the man…in that council meeting…The gentleman with FACEOFF who got up to speak was told…that I had not told the whole story to the group, that I was lying and accused of ‘illegally selling’. Thanks again for listening.

Alley – when I spoke with you on the phone, I told you I was tired. There is more to it than that. I think I am having daily seizures and it is taking a toll on my body. I am not giving up but my health is paying the price. I pray that someone/thing goes our way because the 18th may just put me in the hospital. So when I do not answer, do not stress. On Wednesday, June 17, Bill Mick takes a call from Nikki Lally during the 8am hour of his radio show, Bill Mick Live (which can be heard from 6am-9am weekdays on WMMB 1240/1350, and at your leisure on his podcasts). He isoutraged by her story and speaks out against the injustice of what is happening to her. He tells his listeners that if anyone tries to remove Nikki Lally from her land on Thursday, they should go to jail!

On the morning of June 18th, the Lally story breaks in Florida Today, along with a video. At the end of that story, Nikki says to the reporter:

scared of your own County!

 

But Wait!

Something else happens that day too…

Following Nikki’s passionate, tear-filled plea for help on Bill Mick’s Radio Show the day before, and the response it gets from Bill Mick and his listeners, Brevard County backs down and does not remove Nikki and her family from their home, giving the Lally Family at least a temporary reprieve from this unthinkable travesty of justice!

Happy Birthday, Nikki Lally!

 

On Saturday, while we were presenting our issue to concerned citizens attending the Hispanic Business Expo & Trade Fair at the Eau Gallie Civic Center in Melbourne, Nikki Lally turned to me, with tears in her eyes, and told me that she has been so upset with the things that have happened to her since she was first attacked by the Garage Sale Police who have threatened to make her homeless that she had forgotten her own Birthday! Her husband Richard had to remind her that it was today! Since he could not be with her because of his job, Florida F.A.C.E.OFF. threw her a Genuine Hillbilly Birthday Bash, at our North County Stomping Grounds, the Lone Cabbage Fish Camp. And as we all watched the gators and the airboats, and celebrated her Birthday up right with her, we also had a few things to say, about the Government Idiots who have made her family’s life so miserable that…

Hi there Bill

I just wanted to say you again for letting me speak. I try not to paranoid but I have to tell you that I think Brevard County is trying to kill me. After the nightmare of last year; those 12 weeks of almost weekly visits from Code Enforcement, finding out at the July 7th Commissioner’s meeting that after being told Housing and Human Services had found $70K of leftover hurricane grant money – we were informed that we were no longer eligible after working on it for over a month……………

I have a seizure disorder (Epilepsy) and I have it on record that I had over 30+ seizures during this period. I am in fear of my life that the stress of another attack from Brevard County will not let me survive it.

Another strange thing is when I spoke with Comm. Anderson’s office to get help in trying to get my Code Court date rescheduled, David said that he recognized me from Caller ID and he said that he had to be careful in speaking with me because it might ‘hurt my case’?!?!?!?!?! WHAT CASE??????

 

And Comm. Infantini is wrong because I have it in writing in regard to the compromise. I will send it to you.

PS: I am curious as to who really has the power in the county since I had Wanda in Code Enforcement tell me that Robin (Mel Scott’s assistant) gave her the go ahead to go after me. Even though, they have it in their own notes that an agreement was reached with Commissioners.

So who is in power?????

Thank you for meeting with me today. This email will serve to memorialize the inspection of the safety issues identified in the July 13, 2009 agreement letter. Per the Board of County Commissioners direction these items were to be completed within 90 days ending today, October 7, 2009, and the result of today’s visit reveal that all the safety items listed in our agreement have been satisfactorily completed. This information has been sent to my supervisor Robin Sobrino, Planning & Development Department Director and to Mel Scott, Assistant County Manager and will be relayed to the Commission.
