When Judges decide to be LAWMAKERS

~When did Judges cease to be conscious of their part to uphold laws not make them? Judges are not lawmakers. We have different branches of government for that very reason. When judges fail to understand the laws set forth for them to use, to look for guidance in making judicial system decisions then it is time they remove themselves from the judicial bench and let someone who knows how to administer justice and follow those laws set forth, to take over. When judges are incapable of making that decision then it must be made for them.
People, we have far too long ignored the judicial system and what goes on in the courtrooms. We must be more willing to take notice and not let our court systems decay any longer by unknowledgeable judges who are unable to comprehend the judicial process or are paid off to look the other way, hand down decisions made on their own vindictiveness, emotions or just plain ignorance.  A great example, Judges who override a jury’s decision to award damages just because he thinks the amount was too much so he changes the jury’s decision to suit his own, the decision he wants – this did happen by the way – wonder why they had a jury when the judge made the final decision.
 And when judges are so envious of what homeowners might get if they are given a jury trial – they make sure their case doesn’t reach a trial by jury. This has also happened many time over. So many judges disregard the laws set for them to rule by overlooking and make up their own decisions based on envy, hate, jealousy, stupidity, lack of knowledge, greed. This analysis certainly does NOT apply to all judges but one could say most. As one intelligent judge said, “I am a judge not a lawmaker”. He went on to note that judges are supposed to make decisions on those laws that have been set forth and use precedent cases of law to be used and guide them along. Cases precedent made by higher courts are not to be overlooked, ignored or dismissed. When judges cease to be conscious of their part to uphold laws set forth, not make them up to suit themselves, when judges fail to understand the laws, are not able to even interpret the true meaning of these laws, it is past time they remove themselves from the bench.  When they go too far, they are proven and labeled incompetent, vindictive, ignorant or when proof arises that they were bribed or paid off for a decision their legacy fails forever. There is no question that some judges have failed to uphold the oath they took to uphold the laws with dignity and honesty. That oath has for some judges, been replaced with dishonor and a disgrace to the judicial system and a betrayal to other law holding judges of honor and loyalty to our court system.
But shamefully, we have the good old boy scratch and sniff, camaraderie of those judges that bond together to avoid justice to the tune of doing favors for each other to subvert the law. Those judges who dishonor the oath they took to uphold the laws will leave the bench with a legacy of scorn and disgrace. Slowly but surely, ugly truths are emerging about how the judicial system is overstepping their authority. The brute facts of legal destruction, a failure to maintain standards. Judges who become mastery of fiendish thieves of justice – rogue in robes to thedisgrace our democracy – the courts for sale, doesn’t get much worse for courtrooms and our judicial system. A consistent lack of integrity and decaying legacy for those who overstepped and bypass justice.
One Ohio lawyer stated, cases are not won in courtrooms, they are decided between lawyers usually over dinner or in a bar. Usually a bar. Some lawyers will make a good showing in the courtroom, some will just sit there. Before we move on to four judges who not only failed as judges but as decent human beings, let’s go with a couple of stories which are true.  You can’t make this stuff up – Well, you could, but you don’t have to.  A lawyer from Nelsonville Ohio and a lawyer from Logan, Ohio. The lawyer from Nelsonville was very aggressive, the lawyer from Logan was more laid-back. Mr. Nelsonville lawyer got so frustrated in court when questioning a client, his face became popping red (looks like the old boy was going to have a fit of some kind or rupture his time) and of course, the judge being his friend and same political connections, felt sorry for him. After all, he wasn’t getting the response or answers he wanted. His cocky arrogant attitude almost caused him to implode but back to the meaning of how crooked these two lawyers played the game. They did small talk of how much one charged, the one in Logan once said he would have to raise his fees, he didn’t know Mr. Nelsonville charged more, anyway, that’s not the point. What caught these two off guard – Mr. Logan sent client a letter but in that letter was also an email which got mixed up that was not to be sent for the client to see- it was from Mr. Nelsonville. Logan lawyer schemed to deal without clients permission with his newfound lawyer buddy. These two concocted their plan. The judge, known for riding the fence, goes along. The decision for Logan lawyer client that these two made was not even legal. Client talks with another attorney. His remark, “that’s against state law” – meaning the decision this judge and these two silly ass lawyers concocted. So, $3500 and I will take care of this matter. This lawyer files motion – judge straddles fence, has to rescind the verdict. Did this judge acting, rule out of ignorance or a just go along with his comrades? By the way, the $3500 to reverse this judge’s decision was twice the amount the two crooked lawyers had settled that the defendant would pay. But the wrongful and illegal verdict would have been on the defendant’s record. Did not amount to much, but the principle of the case was important. One who believed in justice, but that has long eroded. There are no lawyers or judges in this one town, that I know of, who can’t be bought off or even knows the laws. It’s usually, “let’s make a deal” – to hell with right or wrong.
