What’s in Store for Debra Milke in Court Tomorrow 23 September?

Phoenix, AZ—The prosecution of Debra Milke is rapidly imploding. Maricopa County Attorney Bill Montgomery was apparently influenced by too much twisted gossip about the case when he painted himself into a corner taking the hard line. Like the late Wendy’s Fast Food TV pitch-woman Clara Peller Montgomery should have asked his subordinates, ”Where’s the beef?”
Montgomery’s evidence consists now of the debunked lies of a disgraced serial perjurer and former sex extortionist cop, Armando Saldate. No motive, means or opportunity for Debra Milke exists here that ties her to the crime. By Monday even that tainted evidence may well evaporate.
The paltry employee family member death benefit that Milke got with her new job at John Alden Life Insurance Company was not enough to cover Christopher’s funeral. I can’t imagine anyone believing $5,000.00 split three ways was a motive for the little boy’s murder.
The only possible theory of a possible motive for murder was that of James Styers. Milke had gotten a new job, put a deposit along with the first months rent on a two-bedroom apartment and enrolled her little boy in kindergarten/day care.
Styers suddenly was losing any opportunity for a relationship with the young mother. Styer’s somehow thought his making the child disappear would bring Milke crying on his shoulder and finally give him his chance to have a relationship with her.
There’s certainly no doubt as to the guilt of Styers and his boyhood pal Roger Scott in this despicable and horrible crime. Unlike Milke their incriminating statement are on tape and later a court record.
Monday afternoon there is a status and scheduling conference in the courtroom of Judge Rosa Mroz. Milke must appear there personally in order to waive time under the speedy trial law. Saldate’s lawyer Larry Debus wants to end the participation of his client in any future proceedings and may well have him in tow to express his need to take the Fifth.
Should that happen Judge Mroz would have no real option but to excuse Saldate from testifying. The judge made it clear that she must then preclude Milke’s so-called confession.
Montgomery somehow had a pipe dream that Saldate’s prior testimony could be admitted without him. That theory fails when you consider that Milke has the absolute right to confront and cross-examine Saldate not only on his claims but his deplorable conduct that was precluded at the first trial.
When Judge Mroz drops the hammer on Saldate’s Fifth Amendment issue this case is over. Montgomery has reached the court of last resort here. Monday will be the proper time and place to set Milke free. Spending nearly 24 years in solitary confinement is a terrible price few murders ever pay. Milke is innocent but has been punished nearly to the ultimate penalty anyway.
