Phoenix, AZ—After 24 years Debra Milke faced her antagonist in court, but she’s no longer in chains.
Debra Milke is free on bail as she fights to clear her name. There’s no chance that Milke will be convicted again and today the new trial itself seems very unlikely.
Now it’s disgraced former police detective Armando Saldate that’s getting the kind of negative attention Milke endured for well over two decades.
Milke sat and watched the embattled Saldate, “take the fifth” and refuse to testify fearing self-incrimination.
Maricopa County Attorney Bill Montgomery is insistent that the shamed ex-cop repeate the same perjured testimony that put Milke on Death Row. He knows Saldate lied but does not seem to care. It’s more about covering up the misconduct involved in the prosecution rather than seeking justice.

What you will learn is that state and federal prosecutors seem willing to look the other way with respect to Saldate’s crimes against Milke.
However they can’t and didn’t promise Saldate he won’t be prosecuted in connection with a number of his past crimes in unrelated cases.
Saldate is facing at least eight documented perjury traps any of which could land him in prison. Saldate has little choice but to take the fifth and keep his mouth shut.
This is not lost on Judge Rosa Mroz who must now protect Saldate from his own words. She really has no choice but to allow Saldate to escape from providing the testimony the prosecutor wants.
Judge Mroz vowed to render her decision in the matter next week. The biggest clue to what her ruling may have surfaced when she vacated a hearing set for 13 January on motions seeking to suppress the alleged confession and to dismiss because of double jeopardy.
I was scheduled to testify at the now cancelled suppression hearing but frankly I don’t see that happening now.
When Judge Mroz rules Saldate has a right to remain silent the other issues will become moot. Since no evidence exists the prosecution will implode.
