Man has filed Trademark on OCCUPY LOS ANGELES
Occupy Wall Street Comes To Downtown L.A. – We Are The 99%
HELLO EVERYONE,
I am a lawyer and I do trademark registrations. I noticed this and so want to explain this to you.
1) MAN CLAIMING OCCUPY LOS ANGELES. A man named Jeffrey Pierce Henderson on November 22, 2011, filed a registration to try to claim the words “Occupy Los Angeles” as his own. He is claiming the trademark as the name of a political organization. In other words, he is claiming he owns Occupy Los Angeles the org.
THIS IS THE category he has used: Goods and Services IC 035. US 100 101 102. G & S: Political action committee services, namely, promoting the interests of Occupy Los Angeles in the field of politics

The application is NOT done correctly, and he is not using an attorney. Non-attorneys sometimes think they can file Trademark applications, but it is a very complex area of law, and they almost always get it wrong — as this applicant did. The application is incorrectly done, bogus nonsense, and will probably simply be rejected out of hand by the Trademark Inspector Attorney. Still, it is important to keep an eye on this and if it ever gets that far, to file an Objection. If it got to that, that would be in about 2 – 3 months. The Objection must be filed very carefully. If you all would like, I am happy to file that on your behalf if you let me know.
IF GIVEN THE GO-AHEAD by Occupy L.A., I could even contact the Trademark Inspector right away — and I think this is important to let her know that he is NOT acting on behalf of the group.
PLEASE LET ME KNOW IN SOME SORT OF OFFICIAL WAY. IF I DO NOT HEAR WITHIN ONE WEEK, I WILL ASSUME YOU PLAN TO HANDLE THIS SOME OTHER WAY. Please email and we can figure out how to go about it.
A trademark belongs to the person to first use it or to first register, whichever comes first. Obviously, Occupy Los Angeles is the first to use it, not this man.

2)OTHER MAN CLAIMING OCCUPY LA – IT GETS WORSE_ A MAN NAMED AARON HAWKE OF 1801 Cielito Avenue, Monterey Park CA is claiming the trademark on OCCUPY LA for use on Tshirts, hats and sweatshirts. HE IS CLAIMING AN INTENT TO USE THE TRADEMARK — MEANING HE IS RESERVING IT. YOU NEED TO WATCH THIS AND FILE AN OBJECTION TIMELY!! The real Occupy LA has been making Tshirts and other items and should be the only ones allowed to do so — if he gets his trademark approved, HE will be the only one who can do so.
3) MEDIA COMPANY CLAIMS THE WORD: OCCUPY – MOST ASTOUNDING OF ALL – a book company has paid a lawyer to file a registration for the word Occupy. This is NOT likely to be granted by the Trademark office, but if it did, it would stop up a whole lot of politics and communication just so this company could make some $$$. I am trying to paste this here because this is SO OUTLANDISH!!! All any trademark examiner would have to do is GOOGLE and they would find a million or so articles already using the word Occupy to discuss political change.
if this one were to progress along, which is NOT iikely, it would require a filed Objection.
THERE ARE MANY MORE SUCH APPLICATIONS. THESE ARE JUST THE ONES MOST APPLICABLE TO OCCUPY L.A.
