Will Judges uphold bank fraud in Athens County, Ohio? Will Clunk Law Firm from Stow, Ohio continue their actions upholding Ocwen Loan Servicing?

The evidence comes from the Plaintiff by none other than the infamous law firm John D Clunk from Stow, Ohio.  Some of you, may be familiar with this law firm, as they are on the net as a foreclosure mill law firm.

Look at this case as a perfect example of what is happening to homeowners across Ohio. The evidence speaks for itself.  Ocwen Loan servicing has tormented so many people, look at the complaints filed with the State which the listings are public on the Attorney Generals website.  Ocwen took over Litton Loan Servicing in 2011.  Litton Loan Servicing was bad enough.  When I called Ocwen, I was routed to a call center in India constantly and my questions were never answered, just the run around while illegal and excessive fees kept accumulating while Ocwen could not answer my questions.  After Ocwen gives the run around and won’t answer, A person might say “Enough is Enough- show me you have a right to be collecting payments from me” because I am receiving multiple letters stating different companies.

In this case which is unbelievable and if you are interested in foreclosure cases, this is a great case to look at and be amazed at the fraud, at the injustice that is going on every day.

Clunk Law Firm representing the Plaintiff was asked to show the original mortgage and the orignial note.  After time went by, they presented a note and mortgage, not original and defendants affidavit stated that – they also presented an allonge dated 9 years later after the trust had closed and a bailee letter stating yet, another owner and holder.  The allonge stated as of July 31, 2012 that New Century Mortgage Corporation was the owner and holder of the note, at the same time presenting the bailee letter which stated C-Bass.  The Plaintiff filed the case on March 27, 2012 but yet Ocwen creates an allonge in 2012.  New Century is a dead company, a defunct bankrupt entity.  Even the State of Ohio had a case, public knowledge banning New Century from doing business in the State of Ohio because of their actions against homeowners.  Ocwen, U.S. Bank, as Trustee and the Counsel upholding this fraud is still pursuing.  There are so many problems, broken chain of title, the PSA renders it VOID by their OWN RULES, an allonge trying to transfer to U.S. BANK in 2012, years after the trust closed.  Why are the Courts still upholding this being thrown on the Courts and the homeowners.

Long story short – the defendants opposition to summary judgment was shoved aside- Clunk Law firm presented a judgment entry months later and it was stamped.  The judgment entry claimed there were no genuine issues of material fact.  There are genuine issues of material fact, as the evidence was submitted.
