Wrongful Conviction of Sgt Edwin Ehlers II, USMC

This is the story of the wrongful conviction of Sgt Edwin Ehlers II at the hands of the United States Marine Corps. Sgt Ehlers was not given a fair trial within the military justice system, as required by law.

 

NCIS agents admitted to tampering with “evidence” used at trial, violating his Miranda rights, and NCIS agents fabricated a confession to gain the conviction which is documented in an NCIS report of investigation. In the record of trial, the military judge stated to the court that there was no proof of a confession and that he would not consider the testimony of the NCIS agent with regards to the Miranda rights violation.

 

The alleged victim told NCIS agents on camera that she was coached in her accusations, but refused to provide the name of the person who told her to blame Sgt Ehlers . It was later discovered that the child’s mother, in front of a witness, told the child to blame Sgt Ehlers. This witness advised NCIS of this fact and was later not allowed to testify at the trial.

 

NCIS claims that Sgt Ehlers failed the polygraph they conducted, but have been unable to locate the results for review. The polygraph was also not video or audio recorded and was conducted by a lone NCIS agent. Since the NCIS polygraph never went through their quality control procedures and has since been “lost”, Sgt Ehlers underwent another 4 tests conducted after his incarceration. All were video and audio recorded. He passed all 4 exams.

 

The military trial counsel vouched for the credibility of the alleged victim, the military defense counsel did not present a defense at all and the father of the alleged victim, a religious program specialist, lied about taking his child to the hospital where he said he was turned away but then signed into the E.R. for the treatment of his daughter, but the hospital has no record of such a visit.

 

The alleged victim herself admitted at trial to lying to NCIS agents when she was recorded as having accused Sgt Ehlers’ ex-wife, former mother-in-law and a neighbor of witnessing her assault (which none of them were ever questioned about their alleged involvement). She also stated to the court that she “did not remember” anything to the military judge.

 

The Judge Advocate General, Vice Admiral James W. Houck, has been aware of these issues for the last 5 years and chosen not to do anything to correct this injustice. Sgt Ehlers was given a 25 year sentence (later reduced to 19 years by the convening authority) based on these outright lies.
