That is correct. The elements for libel (written) and slander (spoken) must also have met the test in law that that what has been declared is a lie, and that that was malicious intent. But as I mentioned this is the underlying problem. The law states a person can run for office and use a pseudonym that isn’t even registered to their person. On top of that they can opt for a third party to vouch for their identity and that gets them around having to show ANY legal form of ID to verify they are who they say they are.

While I am here, just let me expound on legal process. When someone fiiles a Complaint and the respondent, an Answer, the process that follow is Discovery. Everyone exchanges evidence requests. These actors and their representatives know this. They do not wish to stand up to Interrogatories, the required production of real documentss, and even the depositions. You may read Ed’s response to the Haskell compaint on his website. After than Answer was filed, they did nothing with the 120 pages of information submitted. Last February that would be one year since the Clerk of the Court showed the Answe was filed. Chances are they hoped for a non–response or some other court action on Ed’s part, such as a Motion to Dismiss. It is likely that case will be dismissed eventually by Monroe County Court due to inaction. My bet is that Haskell is hoping that will happen so he doesn’t have to retreat from his request for a jury trial. A jury trial would be outstanding on Ed’s behalf, so letting all know, Ed is well informed in these matters and stays within the letter of the civil law code.

How Not To Handle Slander On A News Web Site
When someone is slandered in public, the only sensible manner to deal with it is to challenge the offender to back up their accusation.
And in my particular case, when Pete Scumtilli shows himself to be a liar when he fails to show proof, the administrator should make an announcement to that effect on the same thread where the offence was committed.
To simply delete the thread, as beforeitsnews has twice done regarding Scumtilli slander, amounts to sweeping things under the rug.
To me this is irresponsible behavior…particularly when I specifically requested that Scumtilli’s latest slander of me be handled in this manner.
Despite my request, which is quite reasonable, once again the thread was simply deleted.
Thus far I have not given the courtesy of a reply to my Complaint, nor was an apology offered by BIN.
Accordingly, it is not known what action if any will or has been taken against Scumtilli.
I began calling this low life scumbag Scumtilli after he made the same false accusation against another member ‘Middle Aged Mayhem’.
